  1. Just an update. I asked for, and got, 2 months which I thought fair. They tried to pressure me into signing the SA a couple of days after I received it. I pushed back on this too and got 10 days to consider, and the termination date to match. Thanks for the replies.

  2. Thank you! Just wanted to inform everyone that i have succeeded in my claim and won in full including interests and expenses. Judge was very clear that Parcel2go can not limited their liability under costumer protection act via their terms and condition which are unfair and unenforceable. He went straight to the law and legal point on protection provisions and ruled in my favour. Parcel2go representative tried to argue that it was my choice not to take additional protection but judge dismissed it as irrelevant and that the law is very clear and their liability should not be limited. Furthermore he said that protection would likely to benefit myself and PArcel2Go and is unfair that i should have taken the cost of it. Representative also argued that amount of protection is relatively small in the context of goods value. I have counter argued that it is in addition to standard charge and cost becomes more than 10% of value for inland delivery. Judge agreed with me. Separate thank you to BankFodder who's was incredibly helpful through the process!!! And than you to this Forum to guide us on our right and held businesses accountable for their poor service!

  3. I do not post on here in order to outline ways in which a person can get out of paying a legitimate debt. That is called debt avoidance. As I stated yesterday, the decision on whether to pay or not must be yours.

  5. You are entitled to a full refund AND to 250Euros under EC 261. Those are 2 separate claims. Travelup needs to process your refund. See article 8 You don't need to go all the way to SCC. Just get written evidence that they refuse to refund you for a flight that was cancelled. (Flight cancellations on the same day of flight automatically award you right to a refund regardless of what anyone says). Once you get this written confirmation do a chargeback on your debit card if you can (I'm not entirely sure how this works in the case of debit cards, someone else here might be more help) Your EC261 needs to go straight to BA for the extra 250 Euros (equivalent in GBP). See article 7 They will need to prove the cancellation was due to an extreme and unforeseeable circumstance to deny it. They might try to feed you lies and tell you a snowflake was an extreme and unforseeable circumstance, as they often do, but don't let them.

  6. Your figures don't take into account that the asylum process takes over a year as it's almost ground to a halt. '27000 arrived last year less than 1000 have had their applications processed'

  7. We would never recommend a particular GAP Insurers. In general GAP Insurers, same as other Insurance will always limit any possible claim payments. Make sure you check fully how any Insurance would provide cover to make sure any premiums you are paying make it worthwhile.

  8. 1. Paragraph 2 is noted. I have had financial dealings with The Student Loans company in the past. I do not recall the precise details or agreements nor does it appear the claimant having failed to list the accounts numbers within its particulars. I have therefore sought verification from the claimant with regards to the account and have yet to comply with my requests for further information. Andy

  9. @Surfer1 I've edited your post to remove the registration number, but left in the year of first registration identifier. As Homer67 said, the argument here is whether the vehicle was sold as a 2018 model or as a 2018 registered vehicle. It looks as if it was sold as 2018 first registration, not as a 2018 model, so I doubt you have any comeback on that. Let's see what the experts think. When you say you were "given the impression that the car had a Jeep brand warranty and not a third party warranty" how were you given that impression? The ad to me gives no indication one way or another. Did they specifically say so? If not how was it communicated? What was their explanation (if any) for saying 1 previous owner when there were two? How long after purchase did you ask them about this?

Earlier info was posted on the assumption the letter was an ecn, it wasnt it's a CN as a result of an unpaid PCN. the op didnt post up the letter till latter in the thread though its now in post 1 and the thread title was latterly updated. he didnt get the PCN , for whatever reason. the appeal forms should work in resetting things. now if he is legally liable in relation to it, being a limited Company etc etc is another matter. but as the OP has not legally informed as they should the correct authorities etc of the fact it folded ..... me thinks thats a dead duck. the original offence occurred whilst the van WAS hired to his company.
