  3. I think the only one who is misrepresenting anything is you, quickly followed by an anti corbyn rant about how he's to blame for all labour's problems. Conveniently ignoring past, present and future events... I really struggle to connect with people in this country who seem unable to think about any inter connecting series of events in order to properly understand the results. It's almost like causality doesn't exist. In terms of practical examples; I dont need to give any. Just like Marx, I'm highlighting problems to do with capitalism (obviously not comparing myself to Marx, although I think it's interesting that people are still coming to the same conclusions as he did over 100 years after his death). The way I look at it is that if you see something that is broken, do you sit there and say oh well, we've got no practical product that does the job better, so we'll just accept this product as it is. We're more likely to produce something that does the job better, build on it, and eventually have something that is so much more superior as that is the definition of capitalism. It's actually a massive irony that in a "free" market capitalist world we live in that relies on expansion and evolution, we are unable to expand and improve the system of governance we have. Conservatism exists to conserve the existing power structures and build on their own wealth and power, so another lie is that they are progressive. They are not. The left are. Hence why we come up with issues specifically to do with the systems we use and possible resolutions for them. Conservatism just tells people socialism is bad and socialists are lazy. It tells people that communists are out to kill them in their beds, and are sneaky. All simple slogans that keep us all fixed in the same state of flux; never developing past point A. All that's happening is that the wealth of the 1% is developing to such a point that when the asteroid finally hits earth they'll all have left and be living on mars, whilst the rest of us will be sat here wallowing in our own mess as we burn to death.

  4. My point was that working class isn't working class anymore. Work has been totally changed compared to what it was, where there's less industry. People just want jobs, and the Tories promise that to them. Gone are the days of heavy industry and real proper jobs. The class system that capitalism creates has shifted over the last 30 years. Post blairite Labour (as you call them) now represent the working poor, and people that struggle to get by. The underclass that privatisation amongst other things has created. The point is that what I'm talking about would eradicate any notion of anything being completed at the expense of other peoples efforts. What people get in and what they get back are largely determined by market forces, which are often grossly unequal, and prioritise things that are only of benefit to that individual market. You can't have this discussion without referring to money because it is capitalism.

  5. TJ By you two, do you mean Jase and myself? If so, I am sure we don’t have identical ideas; after all I could walk into them in the street and not know. For the record, I believe most of the policies in the labour manifesto were sound, denationalisation of water , taking rail back into public hands - I assume that would be a slow process as franchises came up for renewal. Education and health , who can argue and not setting artificial limits on migration, well I didn’t see anything to say it wouldn’t be managed. I worry as I always have about letting membership decide the leader as that can be and is manipulated. I see nothing intrinsically wrong with MPs having to be reselected at each election. I know of one ex Tory MP who would have been deselected because she did her job and stood up for what she believed as opposed to the Tory coffin dodgers who ran that area. Just to note, your misquote of from each according to ability, seems to me to be some sort of social contract so if you are able you work and get an income. If you swing the lead you don’t and if you are unable to work you still get an income. I think you also misrepresented what Jase said in that I also agree Thatcher destroyed any industrial base we had and hurt the unions. This has led to low skill, precarious jobs. Also she fooled many in social housing into thinking they were middle class when they bought their homes, also artificially boosting the economy when they released equity ( because of discounts up to 70%) and went on a spending spree. I have no idea how old you are but I have lived through the 70s and 80s , can remember Richard Coles when he was a pop star and saw the convoys of police driving to pits to take on the NUM. .

  6. Seems to me that you need to ask VF exactly what was left outstanding when you stopped using their services. Ask VF for a complete breakdown. At the moment, the position is too confusing to make any argument or to enable you to negotiate any amount owed.

  7. It may be a world wide problem but much worse in what used to be called the first world I think. As some know I am on my jollies in Kyiv and in 5 days have seen less homeless people than I see walking up the ramp by McDonalds in Birmingham. I’m not convinced it’s just down to the weather as it has been quite mild here. The new right and neo liberalism have a lot to answer for, small state=less support unless you can afford to pay extra for it. Then the ideology seeps into the public consciousness which makes people believe it’s the homeless people’s own fault. If they didn’t drink/smoke/inject/ gamble all their money away there would be no problem. Personally if my life was on the streets I think I could see the appeal of blotting it all out. Oh and the one nation Tories say isn’t it awful and then vote for Boris while many working class seem to think if it wasn’t for the EU migrants all these people would have a job and vote for Boris. I give up I really do. I would rather have a centre Blairite party in power than this lot.

  8. Those who need most help are always the hardest to reach, the least attractive and the easiest to blame for their problems. Homelessness isn't just about not having a roof over your head, the most vulnerable need a comprehensive support system and for some that support has become drugs and/or the community which understands and accepts them. It's a vicious downward spiral of circumstance and mental health problems - which we allow to happen.

  9. posts are not only made in relation to your situation they are made to inform future readers finding and reading your thread because the title is like their situation but which might be diff to yours. glad to help, a defaulted account is totally removed from your credit file on the defaults 6th birthday. that doesn't mean the debt itself is not still owed as payment/acknowledgement might have been made after the defaulted date so the debt situation is thus not necessarily resolved, hence the warnings/explanations. dx

  10. your gamble... but there are 100's of backdoor CCJ threads here ... water companies do them mobile debt will be sold on to the likes of lowells lowells own the electric bill already too there are also numerous examples of recent of lowells issuing a claimform for merged debts too. you really should be using our search top right and reading up. as said earlier, most mobile/util bills sold to dca's can be battered away, better to do that before they issue a backdoor claim to an old address they must abide by the pre action protocol and send a letter of claim 30 days before a court claim. its then you deal with it via disputing their figures/enforceability. but if they don't know where you live now that will goto an old address as will a claimform removing your right to question. enough said going around in circles. head in sand is no longer the way to go these days that went out the window years ago. never run from debt.

Sorry DX I’m confused, I’ve already done that, they told me months ago they had no data on their systems in relation to their account. the court ordered erudio to produce and they had till today to produce-my question is, if they don’t, is there some kind of application I can make to get their claim dismissed?

  12. So, an interesting twist. As about to leave to take my kids to school my mobile rang. Mobile number I didn't recognize so ignored. Previously I'd blocked Capquest's landline on my mobile. Seconds after it stopped ringing, my landline went (they hadn't called that before afaik). Picked up and conversation went a bit like this: Me: Hello? Silence for a few seconds... Cq: Hello? Me: Yes, you called me. Cq: Can I speak to Me: Speaking Cq: This is Capquest. For security reasons can I ask you to confirm your postcode? Me: Oh, you're the ones that have been spamming me with strange texts and letters recently? Cq: We've been trying to contact you... Me: Well, please conduct all further communications in writing. Cq: We've sent letters but you haven't contacted us in return. Me: That's because your letters have not contained any information indicating why you have the right to be making the requests or any detailed information about the subject in question. So if you write to me with full details of the request and your authority to make it then I will be in a position to decide whether to respond, but everything received to date has simply been requests to contact you with no detailed context supplied so I have treated them as such. All further communications by post please. Cq: Me: OK, we're done here, goodbye. Voicemail on my mobile was an automated message from them as well.

  13. Camdbug, 1.) Your old Student loans signed agreements no longer matter!? Why? 2.) The CCJ wiped them and it is the CCJ that now is the debt. (just repeating so it registers, the fact that they are using original signed agreements to prove a non-existant debt shows, they know not which alleged debt they are attempting to chase.) 3.) No reference for CCJ, it should be 02XYJ09090 ie: if they fail to send reference for ccj then they do not know which "Alleged" debt they are pursuing. 3a.) Demand they produce the CCJ reference otherwise you recognise no "Alleged debt" 4.) Ask to see their application to the court for 'Redetermination'.? (They won't have done this since they have no idea or reference for the CCJ) 4a.) The result is as dx stated ealier the ccj is dead along with the "Alleged debt" 5.) Jog On Eurido or whatever you call them? .......parasites!

  14. Finally received the SAR response from SLC yesterday. Got to be around 100 pages (although most is just screenshots of their system and statement details). Copies of the original agreement and forms were included (very bad quality - from microfiche I suspect - but readable). Have ordered everything and gone through it. Their "Customer Activity Report" runs up until Spring 1998 then has nothing until the beginning of 2010 (will come back to this). It contains no record of default notices sent and none were supplied in the copies of letters sent. The legal department's 11 page "Matter History" commences in Autumn 1999. it looks like they have no records of the first address change (to Ireland) I sent them, with the result that when they applied for the CCJ they were doing it against an old UK address. CCJ was granted early in 2000. Although there is no copy/record of the CCJ itself, they do include the claim number from the courts. They subsequently tried to request an oral examination in late 2000; again against the old address. Not surprisingly this failed to take place as the courts were unable to serve the papers. Rescheduled a number of times before ultimately failing - I was of course totally unaware of all of this. In early 2002 they contacted my mother requesting my current address, which she gave to them (the Irish one I had already notified them about; of which there is no record). They sent a letter in April 2002 to this address (which I recall) simply requesting me to contact their office as soon as possible. No mention of any of the above. I responded by letter saying that I was about to move back to the UK (I moved back mid May 2002) and gave them the new address there; there is no record of this. They have records of account statements being generated but not sent; which indicates that they knew the Irish address was no longer valid. In Summer 2005 there is a curious entry stating "PWOUEF000 Identified as possible write-off" which is then periodically repeated until Summer 2006 when it changed to "OLDCCJ000 Identified as possible write-off" then immediately "PWOABR000 Identified as possible write-off", after which this does not appear any more. After that they continue to apparently send letters according to their matter history, but no copies of these letters were provided (last letter provided was the one to the Irish address asking me to contact them). The "Customer Activity Report" includes an entry in early 2010 showing that they had located me again at my current address via Experian. I had lived here fully registered and publicly since late 2006 and at another fully registered UK address for 18 months before that. Prior to that I was in Australia for just over a year. The Matter History seems to reflect this change of address, but only shows the old address not my current one. Only other entry of significance on the Matter History is a "Decide fate of account" entry in Autumn 2010 with no listed outcome. Matter History ends in Autumn 2011. Customer Activity Report has one final entry after the address change which is my recent request for a SAR. That's it. Virtually no details of the CCJ other than a copy of the text from a letter saying it had been granted containing the court/case reference. Definitely nothing saying that it was transferred when they sold the loan. Covering letter states that the loan had been sold on to Erudio earlier this year and that I should contact them for any further info. Due to the postal mess I had already done this, nd Erudio returned absolutely nothing of any significance. So... what do you think the next steps should be?
