Greetings, just signed up and was hoping someone could help me

 

iv'e been in contact with lowell finance for the past month, i explained i could only afford to pay them a very small amount per mounth due to having very little money (the debt is on an old HSBC account for £1005)

 

they said send a letter in detailing what my outgoins are and we could set something up, i sent the letter 3 weeks ago detailing my outgoings

 

since i sent the letter i have received 3 calls a week whilst i have been out at work requesting i phone them, the majority of the time when i phone them i get no reply, the times i have got through i was told not to worry since they have over a week backlog and even then it can take a week or two to get put on the system, they said the calls could not be stopped since they were automated but again not to worry

 

i have received a Final Notice instructing immediate payment or they will take me to court, i phoned the number to talk to them and spoke to Avtar

 

Avtar would not let me explain what was agreed with his co-workers or why i hadn't paid yet, he would not let me get a word in, he said he didn't care about what problems i am having (fiancee is very sick, going to a specialist on sat) and doesn't care what money problems i have or what letters i have sent, "i don't care, i want your money NOW" "give me your bank details" "give me them now" i explained i do not have a bank account and would have to be paid with my fiancee's card who was ill in bed

 

he then said mockingly "well when your missus is all better give us a call", i had to say goodbye at that point before i exploded, this guy was seriously rude and abrupt, i have been told my letters being processed and then this:evil::evil::evil: the whole conversation was very agressive and very nasty and left me so angry

 

how do i complain? i can barely afford to make the payments but am willing to, but after being spoken to like this i can't bring myself to deal with lowell anymore

Send them the telephone harrasment letter together with a request for you CCa on the account, with a £1 postal order by recorded delivery and keep the receipts, mark it I dont aknowledge any debt to your company and DONT sign it.

After 12+2 days of receipt they cannot chase you until they provide what you have requested, probably never!

Pete, welcome to the forum. :) They'll try to get away with this whenever they can, but with help and advice from the fine people here you'll soon feel very differently about it! xx

You do not have to put up with this sh!t from ANYONE let alone a scummy DCA. I suggest you refuse to speak to these ill bred barsteards on the phone ever again. If they ring you hang up or refuse to answer the security questions they ask you. Here is a very good CCA letter

I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

 

I look forward to hearing from you.

Send this to them in the meantime.

Clownells buy Statute Barred and Unenforceable debts. Lets see what they come up with.

 

You are among friends here. There are a number of other methods of vermin destruction that can be used to dispose of these parasites and we will guide you along every step of the way.

NEVER talk to a DCA on the phone as they will say anything to get money out of you.

Keep everything in writing for further action.

 

Bear in mind DCA letters are designed to scare you and make you call them.

After a while you will grow weary of their baseless threats and demands.

 

As ODC points out you MUST ensure that these "people" have the legal right to collect on any debt.

After all I could send you a letter saying you owe XYZ money and I'll take you to court if you don't pay.

Thank You ODC, i'm gonna send the letter today

 

they expect me to ring them this afternoon with my fiancee's bank details to start payments, i'm pretty sure they said the motions to start court proceedings would start from monday and they could not put a freeze stop on the account, so are they lying about this and if not how long would i have before the courts summons?

Pete, DON'T PANIC.

Even if they do file court papers, which I seriously doubt, you have more than enough time to get things sorted out AND get a killer defence in.

There's enough people around that are fighting DCA's in court ;)

 

We will NOT roll over and play complaint debtor to these "people" any more.

If they want our money then they MUST prove they are legally intitled to it.

Hey we all have debts and that's one of the main reasons we found CAG in the first place.

Hi Pete and welcome to CAG and The Lovely Lowells Fanclub. I also phoned them once before finding CAG and they were just horrible...so rude, threatening and totally unhelpful. The guy I spoke to told me they could have my home sold if I didn't pay up. Anyway I found CAG whilst googling Lowell..got some great advice and support. I CCA'd them and guess what...well the shoe is on the other foot now. Don't let them scare you with their empty threats of court. Get that CCA letter off recorded delivery and watch them squirm.

Hi Pete,

Take peoples advice on here and do not talk to them on the phone.

I used to put up with hassle from DCA's day and night, causing stress and leading to ill health.

It is most liberating to hang up the phone on these pond life.

 

Any how, sorry I can't offer much more advice, as Im a newbie myself, but you have certainly come to the right place for help and support.

Debt Collection Charges

 

There is no legal basis for a creditor or a debt collection agency acting on its behalf to claim collection costs from a debtor unless there is an express provision in the original agreement.

 

Without such provision, collection charges cannot be demanded as a debt due under the agreement.

Hi me and the old man joined today as just received a letter from RED in connection with the beloved LOWELL with regard to a "debt with HSBC".We have been together for 8 years and in these last 8 years my old man has not been with the HSBC. Once a debt has "been sold on to a DEBT COLLECTOR" (unless the LEGAL SIGNED AGREEMENT WAS WITH THEM) they have no legal rights to ask for that money, most of these said companies are nothing more than legalised loan sharks, who use imtimidation to get what they want, unfortunately some people pay all outstanding money straight away. NEVER REPY BY PHONE AS YOU ARE ADMITTING LIABILITY, ALWAYS PUT IN WRITING ONLY. 7 years ago LLOYDS TSB tried reclaim money that my exhusband had had, joint account my signature not on application.ALL THE BIG FINANCIAL COMPANIES BELIEVE YES BELIEVE THAT WE THAT BORROW ARE SO THICK THAT WE WILL NOT DARE QUESTION THEIR AUTHORITY. SO EVERYONE SIT BACK PUT YOUR FEET UP AND RELAX, OH AND BY THE WAY IF THE DEBT IS MORE THAN 6 YEARS AGO, DON'T PANIC AS THE CHANCHELLOR GIVES COMPANIES FINANCIAL HELP IN ACCOUNTING FOR WRITING OFF BAD DEBTS IN THE YEAR END ACCOUNTS

Clownells will not take you to Court. You will soon receive one of their silly Yellow Postcards claiming that they have called at your home and will call back later. This will be dlivered by your postman so that shows the simplemindedness of the imbeciles you are dealing with. Keep this card as it will form part of your complaint to TS later in the process. Following the yellow card you will then receive a series of letters from a company called Hamptons Legal who will try to scare you into making contact. They are just Lowells with different notepaper. You will realise you have them on the ropes when the pass you on to the third set of headed notepaper called Red Debt. Again another tentacle of the Clownells empire. A sure sign of defeat is if they pass you on to a pile of pooh call Mackenzie Hall who hail from bonny Scotland. These are really at the bottom end of a big ple of pooh. So dont worry between us all you are in good hands and we have all dealt with the Leeds Losers and their often illegal tricks and tactics. They can be easily beaten as you will soon find out. Keep all their letters in future.

Pete JR - take the advice given by those on this site who know what they're talking about and don't get into any conversations with these bullies!!! they are trained (some of them actually read from a script) to intimidate and frighten people like you into giving them bank or card details or admitting the debt. If they call and you answer just tell them "communicate in writing only please" and put the phone down.

 

Most of all Relax!! you will get so much help and support from the wonderful people at CAG - you are in good hands now.
