      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Don't N1 them for the DPA failure go for the full lot, estimate the figures you think it should ba and explain this in the form to the court, they wil then order the correct figures be supplied. If you just go for the DPA it just delays the full claim.

 

Do you have the following as you can work the figures backwards

 

total loan

no of months

monthly payment of loan

monthly payment of PPI

 

you can then simply keep calculating the apr using the amount of loan and no of months until the monthly figure matches your monthly figure.

 

Send me the figures and I will see what I can get it back to.

Thanks for your support and post. I have already calculated the figures, based on my previous experience, sent the prelim and lba, but they will not respond.

 

The n1 I want to issue is not just for the info of the interest applied to the loans, it is for the credit agreement, I should of signed to allow them to apply Advantage Gold fees to my bank account and of course the default notices.

 

The final letter has gone off, requesting this information they have not given me to the Data Controllers Office, and I am about to complain to the CEO regarding the conduct of his company, in their breaches of the dpa and the cca. Their will also be a complaint to the ICO as well. I want to show the court that I have tried every angle, that the nw failed miserably and show them us for what they are:mad: If I mention the word, I will get caboted

hopefully this will put a small smile on your face. (for a little time anyway)

 

returning from my recent holiday to southern india (lovely it was) on a charter flight, us passengers were advised a couple of hours into the 11 hour flight that there was a serious problem with the wc's in that 3 of the 6 had not been properly emptied at Trivandum airport, and the 3 remaining wc's were quickly getting full. the Captin apologised purfusely, expressed his embarrassment at the situation, but stated that anyone needing to go should continue to use the wc's.

 

now remember this is an 11 hour flight, and with about 5 hours to go the captain is back on the mike warning that we might not make it back to Gatwick because the wc's were near to backing up. the bar was closed, which caused a great deal of unhappiness amongst the majority of the pasessengers, water was not given out unless specifically requested and we didnt get our 2nd due meal. the poor cabin staff were seen repeatedly going into the remaining working wc's trying to do gods knows what without success. the situation was made worse each time the captain came on the mike with an update as about 20-30 passengers would get up and head to the back of the plane were the still working wc's were.:D

 

about 3 hours before landing. i am ravenous by this time. the charter flights earlier meal was honestly a toddlers portion i swear to god. the Captain advises that we are diverting to Germany in the hope they have an engineer that could release all the pooh off the plane so that the flight again meets health and safety. at this time the cabin staff are standing prison guard style over the once working remaining wc's and refusing access to anyone. thank god there wasnt any bad turbulance.:lol:

 

the whole situation was truely comically. the captain and the cabin staff did do a sterling job as we were only about one and a half hours late.

 

i have been travelling extensively for over 10 years now and have never heard before of a plane being bunged up. i thought that this only happened to humans. and i was also under the impression that planes released that stuff whilst high up in the skies anyway. just goes to show, how ignorant i am about how these things work. i am very reassured to know that when rocks/hailstones fall from the sky they are pure iced water and nothing dodgy.;)

 

do you know after the wc's were fixed hardly anyone needed to use them. amazing isnt it. oh yeah and we did get a second meal a snack which some of the passengers only just managed to finish eating as we were landing. i have never seen cabin staff move so quick. what joy.

 

the landing was a joy (not) i think the plane had been so full of pooh that the captain had not had time to adjust to the weight change once the pooh was released as the plane bounced down the runway at an alarming and unsual speed when landing.

 

ah well made it back in one piece to add my support to you for the battle ahead.

Wow thanks you lovely lot, team effort wins every time.:D I really appreciate your thoughts. I know, I know, but they just infuriate the hell out of me. I might take a vist to Edinburgh and knock on someones door. Corr can you imagine their faces:o They might say ok where's the cheque book, or we are a bank, we have cash, it was yours a long time ago, we managed to t**** you out of it, and we have made so much profit out of it, we are really making millions in profit, oh how much was it you wanted. eh in your dreams eh.:mad:

 

Well as you know, I am a great believer in pacing yourself, there is no rush, these things don't happen overnight. I am truely fed up with their rude and dismissive ways. Somethings got to give, but not me, I will keep on chipping away, as we all will.

Had a response from the Nasty regarding my dpa non-compliance letter I sent for the data they will not supply me with.

 

The want me to pay £5.00 for this service

 

No response from the CEO.

 

True to form aren't they:mad: :rolleyes:

Did I hear you mention that you were claiming back advantage gold charges as well? What angle are you using on that one? (providing you don't mind me asking of course)

Sorry just came upon your post. yes I am looking into reclaiming back the AGF as I never agreed to them, they were just there.

 

I have asked them for a copy of the agreement that I signed accepting them and guess what. they have ignored me,

 

Now the problem I have is that they are threatening to take me to court in pursue of alleged debts (which consist of penalty charges and AGF that i will claim back, the balance on the loan is less than the amount of the mis-sold ppi i want back) So I am debating whether or let them take me to court, defend the whole claim and then counterclaim for everything:D I am sitting on the fence with this one at the moment. to see if I fall off:o

 

They seem to have set a dca after me. So all of this will be added to my court file.:p

 

The last correspondence they sent to me stated they will not respond unless requested by a legal body and they suggest I engage a solicitor. Bit threatening and intimidatory, now why would I need a solicitor.

Interesting about the AG charges, I don't remeber signing anything to get an advantage gold account. Should I have done?

Hello GT,

 

In a nutshell no, I have not progressed any further with my claim, frustrated but not defeated.

 

Now as far as I am aware the application of AGF should of been agreed, and I never agreed to it, it was just applied.

 

I have asked for a copy of the agreement I signed for authorisation of these fees, and guess what, no credit agreement, instead the have told me to look at the terms and conditions of the account. Oh and they never bothered to send them either.

 

I have calculated that they have taken approx £1,298 in fees on this account and that does not include any stat or contractual interest.

 

I am in the process of reporting them to the information commissioner, the oft and trading standards.

 

I will be considering court in the next few weeks, I am waiting to see what they get up too:rolleyes:

I agree that the time is now. I hope you understand what Alan said in my thread about part 18. In your case it seems simple. You have the details except the APR.

I agree that you should go for MAXIMUM reclaim, even over estimate if necessary, and include part 18 to force their disclosure of the information you seek.

I so hope you do it soon.
