Hi recieved this yesterday

received a standard order for stay for settlement with consent of all the parties.

 

District Judge thomas orders that this claim is stayed until 21 August 2007 to enable the parties to attempt settlement

 

On or before 5 sept o7 one of the following steps must be taken

the claimant must notify the court that the whole of the claim has been settled or

the claimant or defendant must write to the court requesting an extension of the stay period, explaining the steps being taken towards settlement and identifying any mediator, expert, or other person helping with the process. The lettere should confirm the agreement of all the other parties

 

 

 

I am guessing that I need now to write to the defendent using the information on the stay link am I right

Hi there,

I have a stay on my claim untill 31st Aug.

You can either object to it or use it wisely (laughing!) to get the bank to mediate.

The banks won't reply to any of the letters (they never do!) but stick to the 2 weeks time limit for each letter and copy the letters to the court so that you can show that you are making the effort to mediate.

Hopefully when the court decides directions it will be in your favour because you have made the effort and they have abused the process.

21st Aug doesn't give you much time.

Maybe someone with greater knowledge will also post a reply for you.

I think you have more than one thread running? I thought I put a post on somewhere for you yesterday or the day before, if you keep to one thread people can see where your claim is at and it's a bit easier.

 

This will serve to bump up your question anyway,

Many thanks everyone, sorry I have more than one thread going I was getting desperate as no one was answering any of my questions on pervious threads. will send a letter tomorrow.
