Just answered my own question I hope:

 

Section 61 Signing of agreement

(1) A regulated agreement is not properly executed unless—

(a) a document in the prescribed form itself containing all the prescribed terms and conforming to regulations under section 60(1) is signed in the prescribed manner both b the debtor or hirer and by or on behalf of the creditor or owner

 

Not only that but the photo-copy of one of the agreements the edges of both sides have been cut off so there is only some of the Address, APR and ROI per day.

 

Just looking at the act and it clearly states in 60 (1) that the debtor is made aware pf "the amount and rate of the total charge for credit".

 

Any ideas on how to proceed from here?

Don't mind me.

 

I'm just posting in here for my own reference (and hopefully others in the same boat):

 

Section 61 (1) (a) a document in the prescribed form containing the prescribed terms is signed in the prescribed manner by both parties. (To be properly executed)

 

Section 65 (1) an improperly executed agreement is enforceable on an order of the court only.

 

Section 127 (3) the court shall not make an order under section 65 (1) if section 61(1) a signing of the agreements was not complied with.
