Hiya

 

im claiming this on behalf of a friend, iu have done about 12 claims so far but this was my first one with Lloyds

 

So basically the back ground is

 

i sent the SAR - they took 6 weeks and sent statements

prelim sent

2 weeks later LBA sent

 

holding letter rec'd - my friend didnt have court fee for 2 weeks, another letter rec'd saying they weres till investigating

 

claim issued and they have until 20th July to acknowledge,

 

I have written to moneyclaim with charges list and i sent a letter to Lloyds also with alist of charges and confirming that i have issued a claim against them and have asked for copys of the original t and c's that applied when the accounrt was taken out, i also sent a sopy of this letter to moneyclaim - comeone suggeste this on another forum

 

So Lloyds seem to be the hardest to squeze money out of so can someone give me an idea of what happens next etc etc

 

my gues is they will acknowledge last minute, i will have to pay £100 AQ etc and then get a court date but i know it changes all the time

Hi

They do tend to leave everything to the last minute, but lately (the last few weeks) there has been a huge amount of payouts, so maybe their tactics are changing??

well they have just acknowledged about 5 minutes ago, so i will prepare to send them a letter now straight to the solicitors.

Hi

 

I agree with Nic - don't appear too eager, you've issued your claim and now it's up to them to defend. And yes, they certainly do play a waiting game which has no logic or consistency to it.

I thought that as soon as you acknowledged you sent a list of charges with a covering letter, this is what i have done with all my other claims, this is not to appear to eager i just have always been told that this is what you do - any one have any other take on this - all help is appreciated

When the claim was issued i sent a letter to moneyclaim with charges attatched. i also wrote to Lloyds asking for the terms and conditions that were given when the account was opened - i am not expecting to rec these at all.

 

now that [problem] have acknowledged i am to send a covering letter with schedule to them - i have just done this this is what i meant on my earlier posting as it is what i have done on all my other claims - i have just been confused as others were going on about me appearing to eager wheras i thought i was following a standered process

does anyone have the full name of the Lloyds solicitors and their address/fax number

 

also they filed there defence last week but i still havent recieved anything, is this normal??

Hi Hanna, they do take their time. I started my claim back in Feb. My court date was Aug 14. I received full settlement yesterday in to my bank account. Here is their solicitors details, good luck.

Hiya

 

I really confused today,

 

well actually i am confusing myself. I havent heard anything from Lloyds or moneyclaim since i recieved the acknowledgement but it states on moneyclaim that it has changed to Defence and will be transfered to local court. this changed on the 18th july

 

I have had nothing since. I have written a standered letter with that charges scheldule to [problem] but still nothing

 

I dont quite know what to do Please help as with all the stuff going on with the OFT i am really in a muddle

well i just got the phone from them and they have confirmed that a defence was logged on the 18th and they will send the defence to me if it hasnt been already and re-issue if not.

Does anyone know, Do Llyods also have to send me a copy of their defence or is it just moneyclaim. and do they have a certain timescale as to when they have to.

 

Also does anyone think i should call them to check that they got the scheldule i sent them??

 

I have taken many banks to court now, over 7 times but have never got to this stage, i know it had to happen sooner or later but it is very daunting, i am spending most of the time reading etc so any help/advice would be greatly appreciated

Hi

You will get a copy of the defence from the Court. It's up to you whether you call SC&M or not, there is no harm in doing so but you probably won't get anywhere.

Still not heard anything from Lloyds or Moneyclaim

 

I was unable to get hold of SC&M on the phone either , just hold music for ages.

 

I have had a thing posted through my door for royal mail though saying they tried to deliver a packet but could not post it through my box so that will come tommorow. i am not expecting anything apart from the letter from [problem] but dont thing this is it as it would be to big if it wont fit through

 

this is stressing me out though only cause my friend is panickig and ringing me constantly, i cant really say much to reassure her either apart from its just a waiting game etc etc

well, no defence rec'd still, it was entered oin the 17th of july so you would have thought it would have been sent to me by now.

 

I have rec'd a letter from Moneyclaim stating that the defence has been lost and that they have written to lloyds giving them till the 20th of auust to re-submit it, if they dont then i can enter judgement.

 

Seems odd to me, i bet they never sent it in the first place especially as the date rec'd shows as the 2nd july on moneyclaim, and they hadnt even acknowledged till after that

So still not heard anything today from moneyclaim so will be calling them in a minute to see if a copy of the defence has been rec'd

 

Sc&M did write to me thou and say that due to the oft case all cases have been suspended - it was a real generic letter and i guess if it was true then i would have heard if the case had been stayed..... based on the fact that moneyclaim lost the defence and have written to them asking for it this is just a fopb off

 

 

all opinions etc etc would be appreaciated

sorry for starting a new thread

 

I am claiming for a friend basically what happened so far is

 

1, moneyclaim acknowledged / defened 17th july

 

2, moneyclaim lost defence gave SCM till 18th to re-send

 

3, letter rec'd stating the case is on hold - very generic letter from SCM not from courts - not a formal stay etc

 

4, spoke to moneyclaim and am able to win by default tommorow

 

so any advice as the letter from SCM has thrown me a bit due to this being the first bit of corry i have rec'd from them

Hi ya,

I'd phone the court and see if they have received any application for a stay from Lloyds, and if not, just continue and enter for judgement. I think Lloyds think they don't have to do anything at all! The court may however say they are staying cases, but that's what you need to know before you go further.
