Wondering if any one could let me know what to do if my bank does not Send me my statements within 40 days as requested it was about 2 months ago when i sent the letter and i recieved a letter saying that they would comply but it may take a little longer to action my request as they had a lot of other requests latley like this.

do i have to wait...

You are in control of the time so if they have taken longer then 40 days send them the non compliance of DPA letter. Its in the templates

28-05-2007--Received Schedule of Charges.

03-06-2007--Prelim sent.

12-06-2007--Reply - Thanks but charges lawful!

19-06-2007--Sent L.B.A. & Schedule of Charges

NOTHING RECEIVED AFTER 14 DAYS

05-07-2007--Phoned Halifax to discuss account. Still standing by charges.

13-07-2007--Filed N1 in Hull Court :wink:

20-07-2007--Halifax deemed served.

25-07-2007--Received offer £280 as Full and Final settlement.

27-07-2007--Sent rejection letter recorded delivery

03-08-2007--Rang Hull Court, nothing received from Halifax

04-08-2007--Sent Pre Judgement letter.

10-08-2007--Defence received from Halifax

13-08-2007--Judgement Request sent

24-08-2007--Claim stayed at Hull Court

31-08-2007--Applied for stay to be lifted

12-10-2007--Hearing for removal of stay on 31/10

31-10-2007--Removal of Stay struck out

Welcome to CAG.If they dont send the statements you then send this letter giving them 7 days...

HI and thanks

I have just got the statement of charges made on my accounts and its come up to 2000 pounds

im just about to send in the first letter asking for them to be returned

I will let you know how i get on...

Funnily enough we just applied for a 2 grand loan with them and got denied looks like we wont need it now, Im not desperate for the money just wanted to finnish my driving lessons and get a car, so i can wait! They took 50 days to comply with my request just shows there total disrespect for the rules.

Welcome to the site.

 

Glad youve had your statements back. I see youve done your spreadseets already too. Well Done.

 

When you send your Prelim in ( request for reimbursment) you need to send in your schedule of charges as well. DONT mention the 8% yet though ( dont mention that till it gets to the N1 stage.)

 

You will find that thy will write back with the bog standard reply of,

" We are sorry your unhappy blah, blah, blah,

We believe our charges are right. " or " Sorry your unhappy , we will investigate and get back to you nest millenium"

 

Either way just ignore it.

Always keep to your timescale , not theirs.

 

You are the one calling all the shots here.

14 days for prelim , no response then LBA giving another 14 days then if no satisfaction get ready to fill in the N1.

 

Your a bit away from that stage yet though LOL;-)

 

Anyhow dont forget any problems at all no matter if you think It is too small to ask just holler.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

Are you going for contractual then.

 

I was going to but there has been so muchgoing on with it that Im not even going to try and claim it now. Not until there is some sort of concrete argument that we are sure of winning.

 

I was going to use the 28.9% . whos spreadsheet did you use fo yours.

Ive used mindzia's (only cause Im a dimbo and found this one really simple to use)

 

Have a look at my thread overflow v halifax . Might give you some sort of idea what to expect .

 

Also if you are thinking of going for contractual look at this:

its a real eye-opener. You might change yor mind.

hi all

 

Right i decided not to go for contractual intrest i just sent them a vanilla claim for the charges only and no interest.

I have just got a standard letter back saying

Thanks for the complaint bla bla bla

Also saying that the charges have been correctly applied to my account.

So no offer as yet ...lol

I think its just on to the next stage but they replied early 6 days in to the deadline do i have to wait for the 14 days to expire Before sending the next letter

Right.. Im about to send my second letter ive waited the 14 days and i got a replay saying that they have performed an investigation and found that there charges are fair and they will not be giving me a refund, at the bottom they said that if they didnt hear anything back from me within 8weeks they would consider the matter resolved.

My current problem is that on the template for the 2nd letter it does not include a section for if they replied saying that they have investigates and on the step by step guide dosent give any information and didnt give responce i recieved as an avalable option.

What do you all think i should do? Should I just edit the letter and send it regardless of the investigation.

 

Any help would be thankfully recieved

Hiya

 

Still a bit stuck with this the LBA in the template directory dosent mach my situation

the letter states that they didnt get back to me at all

this is not the case they did get back to me but didnt offer me anything and said that the charges were lawfull

I have no idea what to put in the letter,

Any ideas would be apreciated

Ill just send the LBA then im just a bit worried about jeperdising my court claim by sending the wrong letter

Ill send off the LBA tomorrow and ill update you all when i get a responce or a refund as unlikley as it may be.
