Hi All,

 

Im seeking a bit of guidance and reassurance.

 

Ive been following the process of claiming back my mums charges from lloyds now for above 6 months, im at the point where ive submitted my bundle(my mums) to lloyds and the court and lloyds were supposed to submit theirs by 21st June (they havent)

 

Ive sent the non-compliance letter to the court about 2 weeks ago and every time i ring i get the same answer that it hasbeen passed to the judge and I should hear something soon!

 

I am concerned that this will end up at the hearing which is on 12th August and I really dont see why it should go that far.

 

Could someone please advise as to whether I will be able to attend court either with my mum or on her behalf and if she is there would i be able to do all the talking as she has no idea of the ins & outs and what to say etc?

 

Also do you think I have a reasonable cause to claim my costs in preparing everything as they have never responded to any letter, never offered partial or full payment but simply filed their defence and AQ when necessary. Could this be deemed bad behaviour on their part.

 

Just to clarify we are on the small claims track at chesterfield court with a final hearing date of 12th August!

 

Any help or advice would be very much appreciated as i am very frustrated with this.

Just a bit of an update.

 

Got off the phone to County Court - Judgement made in full for £3692.00 plus court fees!!!! WOOWOOO!!! To be paid on or before 30th July!

 

My now only other question is a bit pessimistic but I like to cover all avenues- what if they dont pay?!?

 

Also Can i now claim costs?!?!
