Hi

Has anyone received a notice of hearing at Bromley County Court for August. I have and I telephoned the court who informed me that they expected the bank to settle in advance of the date. On this basis, can we apply for the defence to be struck out as an abuse of process?

I'm not an expert on this, but I would guess that you can't prove 'abuse of process' at this stage, just on the court's opinion on the telephone. They may turn up.....(sorry, I just fell off my chair laffin!):D

I think you'll have to let it run for the moment, but send DG a nudge letter, reminding them of the court date. They probably won't spark until nearer the date, but use the time to start putting your bundle together, just in case you need it - they seem to be going closer to the wire these days........
