They are just a bunch of thugs when things don't go the way they want- ie we don't just roll over and beg for their forgiveness for daring to fight back.

Well they've got til Friday to decide whether their gonna defend or not. Cash machine took my card today when I tried to get a balance to see whether they had taken any money from my account. Swines lol

Help! I dont know whats going on as heard so many different things. I filed N1 couple weeks ago (13/7) so Halifax have until tomorrow (3/8) to answer claim as to whether they will be defending or not. If they defend they get til 17/8, but due to post strikes and this OFT case I havent got clue whats going on. As I filed before this OFT case came in does my claim continue as normal or are all now on hold? What should I do tomorrow as far as not hearing from Halifax goes. Do I ring court and let them know? Thanks all:confused:

Phone the Court and ask for progress report Kelvid. I did this Morning and It looks like They have placed a stay on my case. I will have to wait until the Court notifies me of the situation, then if stay is in place I will Apply to have it lifted. It seems to be down to each court whether they apply stay or not... Yours might be one the courts that are carring on as normal.

So if I ring the courts tomorrow to see what happening. Cant believe Ive got this far for this to happen. If courts get a stay what does this mean exactly. Does it just give them longer to delay? Deadlines for me where 3rd to reply and 17th if defending.

Your dates dont change because of postal strikes or any other reason. Keep to your dates.

Not all Courts are doing this .Dont get het up untill you know for sure.Get in touchwith the Court tomorow and then you'll know for sure whats going on.

 

I hope for your sake that the one your using is one of the ones where you can carry on.

If it is and you dont hear by the time limit for your bank get to the Court ASAP and file for Judgement. Dont give them any lee-way.They dont allow us any when they pile the charges on.

Kelvid when you do know what is goin on please post it here. What courts are carrying on???? Hope I`ve finaly cracked linky thing it is a big help to all maybe someone site helper or mod will list them all in a sticky eventualy. you could also check to see if your Court is there already.

Kelvid, don't worry. The situation may look grim because of the OFT case, but the unlawfulness(?) of the charges remains.

 

We will all keep going. And as soon as we have seen how this is or isn't affecting claims, we will all put it up on the site.

 

I always get nervous after I've filed my claims. But I get my money back in the end.

Well today I rang Hull County Court as Halifax had to reply by today. Court have not heard anything from them and advised me to therefore send in my request for Judgement form which I will post tomorrow. It appears they are carrying on as normal and leaving the decisions to the judges. Just hope I get one whose being stung by Halifax, lol. I have ticked the Defendant to pay immediately box on the judgement, but was wondering how long before I hear something once courts received it. Any ideas?

if you still have not received your acknowledgement you just need to send your 7 day default letter not the judgement the default letter gives them an extra 7 days to pay up now or will file for judgement

I mentioned this to the courts on the phone and they said why give them another 7 days when they haven't responded to the given deadline by them? What do you think, would you give them extra time anyway?

i would follow the guide lines that are here on this site that way you are following the correct precidure and not giving them an inch to say you havent gone down the correct path

I always think that the more reasonable we appear, the more it shows up the banks unreasonable behaviour.

 

Saying that, if they haven't even bothered to acknowledge, I would be tempted to just go for judgment. It is each person's discretion which route they choose.

Thats really good advice from Tilly, It will show you in good light to the Court and if (heaven forbid) they apply for a stay, when you apply to have it set aside you will appear to be the more reasonable party and have good influence.

hello stones -just wondering how you intend to get the stay lifted?? I'm just about to send my n1 and i'm looking to preempt a stay using finacial hardship if i can.?
