Capital One seem to pay out around 21 days after being 'deemed served - although they usually acknowledge after a few days - dont worry about it:) I dont think theyve stepped inside a court room yet.

I filed for myself and a friend on June 25th, deemed served on June 30th.

 

Both acknowledged July 3rd, so fingers crossed thats all they do :D

My claim was deemed issued on 29th June. Yesterday I received the acknowledgement notice with usual 'intend to defend in full' and on the same day got a settlement from Cap One, for fees, all purchase interest and basic 8% stat interest.

 

I claimed for CCI and default removal and they didnt give either. They also paid £214 of the £600 settlement to a closed account which was short settled, but in full and final sttlement in 2003. They were then sending a cheque for difference.

 

They also worked out stat 8% court interest at just £58 since 2002, on the basic spreadsheet it comes at nearly £200

 

Needless to say I declined

I think i have to give them till tuesday, as its a weekend, so will ask for judgement late Monday, and see what happens.

I got my offer minus the contractual the same day as the acknowledgement arrived so you should be getting at least a partial soon.

 

most people seem to be getting charges + all purchase interest paid + court interest but no contractual. Thats what I got except they added it up wrong, others recently seem to be getting the same offer

Well CAG user called Dad lost a case at high court for contractual interest so I think that set a precedent against awarding contractual interest. If that is the case then presumably you could lose at court if you are arguing the contractual on its own (i.e. if they have offered everything except contractual, then technically you going on to argue just that one bit).

In my case they added up the basic court interest wrong (they put £58 in total but the spreadsheets add it up to £200 odd). Plus they didnt mention the default removal.

 

The default removal was included clearly on my POC so Im happier going to court to argue two points and the fact that they didnt offer full amount plus stat. I think the Mods too agree that if they have offered full charges + stat interest you should accept.

 

but then again even since then Cap One have been paying out to some people but not others. They do seem like one of the companies who settle early and stay well away from the court though.

Hi!

 

Mine was for £320. The papers were deemed served at the end of June, they acknowledged on 6th July and wrote offering a full settlement, which arrived yeasterday. They've said I should have a cheque within 14 days.

 

Hope that helps with anyone a little bit behind me.
