Not at all, my fault for not being specific. I'm thinking they manufactured documents after the fact to show themselves in a better light....unless they've provided actual proof of postage. Anyway, probably best I leave it as there's unlikely to be any proof. False accusations and all that.

You should start a thread of your own, that well you will get the best support from the site and its Lurrrvly members.

 

If you have incurred thousands of pounds worth of charges, that means you WILL get thousands of pounds back with interest. Good luck, i will keep an eye out for your thread :)

Congrats reka on your ongoing campaign, we are all waiting to hear that our Dear Friend at ashurst has made the long walk to the bank for you... No doubt she'll pay in a cheque so you have to wait for it to clear!

Sorry, I haven't been around much lately but I just wanted to pop back and say congratulations - your doing a bloomin fantastic job! Abbey are getting humiliated and also some excellent publicity for CAG and the campaign. This thread and the media coverage will really give newbies confidence. Well done!:D

I just had to say that reading this thread is like reading the pages of a crime thriller. I could NOT wait to get to the "I've won" bit, but instead read each instalment with eagerness. I even had palpitations reading the threads up to the court date and was sooo relieved when I saw that you had won.

 

So Reka, from one single parent to another, very well done. Some things are worth pursuing and we should not be beaten by the big institutions.

 

My court date is 6th August. I've started printing out the court bundle, but I will need to liaise with someone on CAG just to ensure I have done everything required of me. I'm very inspired by your win, but scared to death at the same time. £970 at stake and I could do with the dosh!

Uh huh, Inga made the payment into my Barclays account today, by cheque so i have to wait till it clears but wooooo hooooooo!!

 

My first letter to the Abbey was on the 20th May 2006...... thats way over a year!

Being a bit thick here, but who are "Stalkers are us"??

 

Tah Reka for the offer of assistance. I have completed the allocation questionnaire and sent off with details of my claim, plus I added an extra page of claimants who have had their cases settled by Abbey.

 

I will refer to the guide, so once I have that clear in my head, I may as well run it past you. Would it be ok to PM you as I don't find it easy navigating the site.

Reading this, I think I may have made a mistake. I submitted the claim details to the court, including charges etc, but did not send one to Abbey. Is this a c*ck up on my part? Will the court bundle sent to Abbey's registered address at Triton Square 2 weeks prior to my court date (6th August) suffice? Was feeling buoyant but now feel deflated...

Amtegeee, just send it now, but in reality the bundle should suffice, but i am not sure that they ever look at it, but the court should have sent it on anyway

Thanks Lula. I will dedicate this weekend to sorting this out.

 

I had sent details of the claim to Shabbey at the outset, using the spreadsheet and asking for my money back. They declined of course, but as the court hasn't struck my claim out, I'm hoping that all is well.

 

I rang the court yesterday to find out whether the judge has asked Shabbey for disclosure of actual costs they incur for direct debits etc that are bounced and subsequently charged exhorbitant rates for. I spoke a some newbie at the court who said that I have to formally request an 'application notice'. Has anyone heard of this before? Will this stall the process? Aaaaaaaargh!

An 'application notice' is a form N244 which is the form you use for making a formal application to the court for things (hence the name). One thing it is used for to update your PoC. Here they are suggesting you use it to ask the court for information about the case. It costs £35. If the court has ordered Abbey to disclose it's costs they will have copied the order to you. If they haven't done that (I think) you can assume they have made no such order (yet).
