Hi Lateralus and HSB Crusher

Thank you so much for my own tread - did not know how to do it so thanks again

My MCOL filed 27/03/07

Deference 25/04/07

Notice of Transfer 01/05/07

I will send a nudge letter to the solicitors and also let you know what the Tamworth court has decided.

I was offerred 50% on the 29th March but because I had paid £120 only two days before decided to let it run its course - now of course I am thinking - why didnt I just take it!! No must be strong - not be a whimp!!

Bring it on!!

:-? Good Morning All

Just had the post and have had the - Notice of Preliminary Hearing - information come in - the date is 28th June 2007 at 12.00pm - they have put in a note that the case may be released to another judge and possibly a different court. Sent the first nudge letter last week so do you think another this week? or wait 14 days? - any information would be helpful

Many thanks

I would send your 2nd nudge letter after 10 days has elapsed... and in this one, include the information that you've received a court date for 28th june and that you'd really like to come to an amicable agreement before this date.

also, if they've not responded to your previous letter, be sure to mention this.

i'm sure it goes without saying to make sure you include your schedule of charges :)

Thank you - reminder now put into diary - am a little worried that I should be getting some information together for the court - have pulled off the Office of Fair Trading information and also the PIMS - Early Day Motion - should I take a chill pill or is there anything else I should have ready for the court day? Thanks again

definitely take a chill pill and relax for a few weeks:)

while i'd recommend that you make sure you have all the paperwork/statments to hand... i'd definitely put off getting your court bundle ready for a while yet as it's a huge amount of photocopying which needs to be done in triplicate!

your court date is 28th june and i'm sure you'll get an offer before then, if you read my thread,

http://www.consumeractiongroup.co.uk/forum/hsbc-bank/82747-cookie-hsbc-their-pesky.html

you'll see i managed to get an offer without even getting a court date ... but every case is treated differently and there's no logic involved with the way dg are dealing with claims.

keep us posted and let us know when you send your 2nd nudge letter and then we'll take it from there.

 Decided to also send another letter to the bank - telling them that I have written to their Solicitors and am trying to save them time and money if they pay me before the court case - willing to try anything

Have just heard that friends of mine just got £3300 from HSBC - did not even go to MCOL but they did knock off £1100 in interest - they seem happy - so deals are still being offerred - this was my reason to writing to the bank again -

I will follow up and send a 3rd letter to the solicitors and 2nd letter to the bank next week - hopefully they will pull up my file and give it some notice

Take care all

Yoko

Also my brother has won by default with the Halifax - another £3500 in his bank xx

  • 2 weeks later...

Hi All

Keeping you in touch with an update to say the letter I sent to the bank was replied to by sending me the standard letter they first sent to me when I contacted them back in February ie we are investigating your letter about bank charges and here is a leaflet etc etc etc. I have sent them another letter asking them to relook at my file as we go to court in 17 days -

Still not a peep from the Solicitors so a third letter has been sent to them!

Has anyone got any ideas? I was hoping that we would not have to court but looks as if this will happen! Has anyone been to court lately and when is the last day the solicitors may finally get in touch?

I will be sending another letter to both bank and solicitors on Monday next week and then again on the 25th - got to keep on trying - you just never know!

Thanks for reading

Karen :(

:D Got my post this morning and have had an offer from the Solicitors - £1316 - this is £326 less than I what I wanted but decided to go with the offer - so thank you Cookie4413, HSBC Crusher, Pink Dutchess and Lateralus I think I would have lost my nerve without you - it is as you all say a waiting game and I do think that the nudge letters helped - thank you again

Yoko
