      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi and welcome bonnie,

 

Louis wu is a star and will guide you through all the complicated bits. I sometimes feel a bit like the court jester in here, but the thing I would say is that I hope you don't want your patio for this summer;)

 

Abbey are stubborn and difficult and everything they do is designed to delay,obstruct and intimidate you . Ignore everyting they say about investigating your claim and timescales, and stick rigidly to the schedule of letters on here and you'll be fine:)

 

My claim is going according to plan and seems to be fairly typical so if you want to have a shufty, look here

i wait with baited breath cos the more i read the more i realise i havent gotta clue what im doing in relation to bundles etc...... been reading on here for a few months now and all its doing is scaring me more (im such a wuss)! just hope i dont screw it up in the translation (if u know what i mean)???

The other thing I would suggest is not to read too many stages ahead of where your claim is at, otherwise you end up with all sorts of possible permutations and your head will spin. You'll be thinking "what if" and not really taking in exactly how your claim is progressing and what to do next. also, pick a few threads you find which are similar to your own and follow their progress:)

bonnie............if you've done it properly then all you need to do is change the date on the spreadsheet to todays date and it does the rest........so in 121 days time when you need to check your interest when you are in final negotiationswith the Abbey , you put in that date and.......kerdunk, it's done for you.:)

the harem has an open door and I don't have an ego, just a headache:confused: :confused: . have a look at the N1.............you can practice onlineand then you print off the final copy and take it down to court. It's a very satisfying feeling walking away with an official document with a court stamp on:)

 

Also, some people on here (no names mentioned,kia) forget to send in their schedule of charges after filing MCOL, and nearly get their claim struck out by the Judge for being a muppet:p with the N1 you just staple everything together so you can't go wrong.

This was a post I answered earlier (and I advised him to start again)

And the worst thing is, he was advised to read the FAQ's and step-by-step instructions a few weeks ago. It's obvious he didn't bother.

 

He said he didn't want to start again, and wondered how he would do so.

i like yr optimism louis!!! (got the beers in the fridge already)! 1 more question b4 i go 2 bed so no rush 2 answer.......... just looked at N1 form and printed it off and was wondering do i just enlarge the PDF form online and type in details then print 3 copies off? i think ive read it right??

with the N1 I made three mistakes on the form before I got it right, so print off a test one before you go for all 4 because they take a hell of a lot of ink

I've had a quick scan over and everything seems fine. I haven't spotted any typos or obvious errors. Take your full spready with interest on because you need to attach a copy of it to each of your N1's so you'll need threee copies

 

 

 

PS I know I'm an old F***, but I find it hard to understand text language on your posts.

You need three copies.............you; the Abbey; the court, plus three copies of your schedule of charges, plus £100. The court stamps all three, numbers them with a claim number, gives you one back and keeps two, and takes your money off you:(

 

And you walk out with a smile on your face thinking............let battle commence:D

 

 

but...........if you make a mistake on your schedule of charges, then it'll cost you £35 to put it right, and it will delay your claim, and you can't get it back. So it's worthwhile making sure your schedule is 100% bob on

The court allowed me to hand write amendments on the N1, with crossings out and all sorts, so you may well be fine. There doesn't seem to be any consistency about how the courts operate, but I think most people on here would agree that the court staff are extremely helpful and understanding, and help you in any way they can.

I filed my claim on friday, so what happens next??? do i get my claim number thru soon or will it take a while now theres loads of claims going in AND also, should i be doing anything while im waiting 4 details from the court??

I'd just about worked out what to say with your first question , and you add another one:) :)

 

Claim number through soon..........I got mine handed back to me then and there but some courts are taking 2 weeks to process. Abbey have 14 days to acknowledge and then a further 14 days to defend. these dates aren't set in stone for them ( see James33 and Knelly K threads for the different interpretations)

 

Then it used to be AQ stage, but if you've gone to Guildford I would expect them to miss out that stage altogether to speed things up.

 

Can't fully understand your 2nd question. Are you saying you've got charges more than 6 years old dating back to Feb 2001, which will be queried by the Abbey because they're more than 6 years old?

 

If you are then you can just give them 2 fingers, because lots of people are now claiming back beyond 6 years

 

 

 

Is that enough to keep you out of mischief or does it just make more questions?????????????????:) :)

You should still be happy, the 6 years technically starts on the day of the N1, but in reality you'll get the earlier ones included because lots of people are claiming beyond the 6 years limitation rule and winning, so don't worry about it....................and if you don't believe me ask mariejader herself, who's currently walking around with a smile on her face, a big cheque in her hand, and feeling disappointed that she never got the chance to execute someboody:)
