      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks! I don't know if I should be filing in court as, by what Ive read I cant go to the SC court with that amount, living in scotland as per they're limits! So would it not just be a waste of money (that I don't have) and time? If I go to FSO do I need to wait until 17th July anyway?

phoned 01977 number today and was told they put an offer out yesterday, should have it by 2morrow! So here's hoping I can negotiate a good settlement when I phone back!

 

Does anyone know if I can ask for interest when I phone to negotiate??

How long does it take to arrive in your bank account???

 

Hopefully I can post 2morrow as a winner! I will certainly donate to this wonderful site as I could'nt have gone this far without the encouragement from the success stories on here!

The hearing, for those that haven't seen my previous posts, is a telephone preliminary hearing. As it's a prelim, I take it there is nothing to submit to the Courts or DG? Should I have anything with me for this hearing on the off chance it goes ahead, for example a witness statement, copies of statements or my POC??

Ring the court. Quote court claim and ask what is required. Get the name of the person you talk to, and log exact time. That way any comeback, you can refer to your call. I won today ( yes I know pete i mentioned it in passing LOL ) and it was only down for a allocation/directions hearing 11th july. sent Full bundle 2 weeks before date and got offer today, 1 week later. if nothing else its a hell of a nudge.

The number I rang was 01977 627422 ( is this the best number?)

 

Im getting so nervous about negotiating this! Ive had £385 of charges since initial claim went in! Ive calculated interest at £1442! whats the best way to get to that final figure with them?

Well - might be best to wait until they offer the full amount of charges.

 

Once they do, you add, "And, of course, you'll be including the interest owing as well as the latest batch of charges which are, today £XYZ, won't you?"

 

If they say: "Don't be silly."

 

Then you say: "OK, I'll proceed down the legal avenue."

 

Then see what they say!

 

 

As for the phone number - if that doesn't work, try mine.

Still hav'nt had a phone call! I guess I must be getting 100% ( incidently I thought the charges were £8884. he said they were £8622 until 30th june so I may have calculated wrong, there was so many my eyes were going square) so I said I would accept his figures.

 

So as soon as the money is in my account I'll be back to donate to this wonderful site. :D

They often just credit it to your account without even informing you.

 

They've even been known to do it on a Sunday!

Incidently as Ive said before most of the charges were took from my tax credit, Ive lost count of the times when I had no money whatsoever to live on for over a week+more!

The charges all started to accumulate when my son died suddenly,and I went over my O/D limit, ( I even pleaded with them to extend it for 3 month, they even made me take his death certificate to my local branch cos I dont think they believed me, but they did'nt want to know)

 

SO REVENGE IS SOOOOOO SWEET

By the way Kenny I know I got huge charges from monument credit card around the same time, even though I eventually got it paid off!

But Ive no details of my account number etc or any details of where theyre based If you could give me any pointers I'd appreciate it!
