Hi I have today received this letter from the court -

 

Before District Judge ...... Lincoln County Court

 

Upon the courts own motion. The court has made this order of its own inititive without a hearing. If you object to the order, you must make an applicaton to have it set aside, vaired or stayed within 7 dyas of receving it.

 

It is ordered that, the Court of its own motion is considering striking out the defence in this action as an abuse of process.

 

The basis for this is the fact that the Defendant is settling all claims of this nature where Claimants are seeking the reimbursement of bank charges, with no claims proceeding to a contested hearing.

 

If the Defendant objects to the proposed strike out, it is ordered to file, by no later than 4 pm on 25th May 2007, a schdule setting out all claims of this type in England and Wales which have procedded toa final contested hearing, and the outcome of such hearings, together with a achdule of all such claims which is has compromised before the final hearing after proceedings have been issed.

 

Upon receipt of any such objections , the court will consider listing the claim for an on notice hearing of the strike out issue.

 

In the absence of any such objections being filed in time, the defence herein will be struck out a judgemtn entered for the amount claimed by the Claimant, together with the appropriate costs claimable on the small claims track.

Well got a letter from the court this morning saying the case has been thrown out and the Judge has ordered Abbey to pay up by or on the 22nd June !

I Have read a few cases in Lincoln where this has happened. It seems Lincoln is a good place to be for Claimants!

I am claiming against HSBC and it has been allocated to Lincoln court following the MCOL route being exhausted.

 

I too have just received a letter, more or less word for word the same, as Zannie received. Sounds good to me!

 

Will sit it out and see if HSBC really want to defend against my claim.
