      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HMM Court hasnt got my N1's yet :-S mind you they have only been open for an hour and a half lol

its all very interesting reading and I am so scared, I filed my MCOL and they have acknowledged and intend to defend all of the claim. They have till the 2nd July to enter a defense. I am soo scared of them turning up and throwing it back in my face. Has anyone had problems when it gets to this stage? My claim in total is for £8020

First things first!! I have sent shania back to school. phew! if u can play down the park u can go to school 2mrw i said!

 

secondly today I have had the usual fob off letter from halifax tellin me their usual bull!

 

I have carried out an investigation of your complaint and I am satisified the the charges have been correctly applied to your account

 

and a leaflet for me to complain to the FO.

 

Stuff you MOFO's I have issued my N1 i said to myself as i finished reading the load of bull they just about managed to compile together.

 

3rdly it takes 5 days for my N1 to go thro the system here, is that the same for anyone else?

Glad the little one is well enough to go back to school. :D

 

I have no idea what the procedure is now we have filed our N1's, SSL has posted in my thread about what we should expect next.

 

Apart from me ringing the court yesterday, I have had no letters or calls from anyone. I find this more frustrating than waiting for statements. I just want to be done with this all now.

 

They know they are going to back down, so why not get it over with, pay out and stop wasting peoples time and money.

 

Keep me posted on what's going on ok.

 

Hope you're reading this Halifax, 'cos your system STINKS!

I am even more frustrated by the fact that my claim is reletivly small compared to alot of other claims I have read about. I just want whats mine so I can pay some pressin debts.

 

Halifax know they will pay up so I dont see why we have to struggle for whats rightfully ours,

Yes lisa i'm having a bad day too! i didn't get my forms from court and when i rang up the court to chase it i got some snotty woman saying 'it takes 5 days to go through the system too',when they took my £250 off me on friday they said i should hear tuesday or wednesday :x i nearly attacked postman this morning telling him to recheck his bag! its driving me nuts

ohh no miz, that does sound like a worse day than mine

 

when I foned court this morning woman told me it takes 5 days to go thro system too, so am gutted about that.

 

This waiting is doing my head in aswell :(

 

we will get there eventually.

Hello all, I'm a bit new to all this so you'll have to bear with me. Anyways, I have been trying to claim back £1,800 of charges from Halifax and sent my initial letter over a month ago. They replied saying that all their charges were reasonable and basically they wouldn't be paying out. I therefore sent them a letter before action to which they have replied yesterday offering me £893.00 in full and final settlement, stating that this would be paid into my account within 14 days. I have today wrote back saying that I do not accept this offer and want the full amount within 7 days. Is this the right thing to do? I have been downloading the letter templates from various websites but am unsure as to whether I should just now accept their offer, as I'm worried if I continue I will end up with even less.

 

Any help would be appreciated

Hi all, just a quick update - i spoke to a chappie at the legal dept and he has advised me that they have reviewed my claim and a letter was sent out on the 11th (may have missed the post and have gone yesterday) and it is an interim offer! not got it yet but will let you know when I do - I am hoping tomorrow

Ok ....Halifax have gone and paid the £893.00 into my bank today...now I don't know what to do :confused: !! They said if I didn't accept their offer then I have to pay the amount back to them...but I wanna keep it!! And get the rest hehe...any advice anyone??
