      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I need a bit of help and I'm sorry if its been asked before..... HSBC defending claim been transferred to my local court, I've heard that there is a court bundle, but being abit simple I don't understand how to go about doing it for our case? I've downloaded the court bundle from here but it's seems like double dutch to me all that ?>>>VS?>>>>>

Could anyone help a simpleton like me please? Only just got the transfer letter through but heard that there is a load of photocopying to do and don't want to be left at the last minute not knowing what I'm doing ... Thanks in advance. :o

It sounds like you dont even have a court date yet so don't worry about the court bundle yet you are a little way off that at the moment. Read this thread as it will help you understand what is likely to happen next :-)

The banks and the courts are swamped at the moment so it is taking a bit longer to get full offers and a settlement. However, not too worry you will most likely get an offer before you have to do all that photocopying :-)

Nothing to worry about, you may get a letter in a week or so with a Pre Trial Review.

 

No AQ - Straight to PRE TRIAL REVIEW

 

 

Remember you have all the support form everyone here It wouldn't hurt to send DG the letter

no problem - send dg the letter - then mark it on your calendar to send them another one in 10 days - there are a couple of ideas on that post for letters - just tweak them to make a new letter every 10 days - hopefully it will only take a couple before they will make an offer.

How long does it take to get anything from the courts? Got my letter from MCOL rejecting judgement the week before last and the defence thingy(thats the technical term!!!) last Monday, so how long before something from either DG or my local court??

Hiya Lisa, love your technical terms

 

The problem is that not only are DG suffering from the volume of claims so are the courts. The delays seem to vary from court to court but I doubt you will hear anything for at least two weeks from receipt of the "defence thingy" and it will probably be nearer to 4 weeks.

 

There appears to be no logic to who or when people get offers from DG, the best advice I can suggest is send a nudging letter (see Latties earlier post) to them every 10 days or so just to remind them your still there and waiting to settle things.

Should we have head something from the local court? Only had the transfer thingy and nothing else.

Do I phone the court? Or leave it a while longer because of the backlog there is likely to be?

Going to write again to DG to give them a bit of a nudge too, its about 3 weeks since I wrote them the first nudging letter.

We got our date for our prelim hearing at our local county court, do I need to start the photocopying yet? Or what? the date isn't til August but on holiday til the 1st of August don't want to get caught out!

Also is it 3 copies of evrything? And do I need to put our details where relevant. TIA

just so you know and we know and you don't miss anything - how about putting up the paperwork on here - just xxx out your name and any account details - then we can advise you better.

but let's see those directions, please.

every court is doing things differently - that's why it's so important to look carefully at the court directions.

 

and next nudge you write to dg - you can say - i see we are due in court xx/xx/xx - blah, blah,blah..... just carry on nudging.

When you should attend.

 

 

 

Thats it nothing else, just waht it says up here! well apart from the blah blah!!

 

Suppose I should start the putting in of our details on the bundle. ready to put on here at the weekend.

We won!!!!!

Without going to court!!!! Tried to ring up yesterday to see if could sort out before prelim hearing next tuesday and couldn't get through. 10 minutes later the postan came with a letter from Birmingham and DG solicitors , no prejudice letter blah!! offer you ....if you keep this confidential .... so just between you and me!!! So what we got paid the remainder of the credit card and bought us a a new tent! Good job we cut short our holidaya in Devon last week coz of the weather shouldn't be home until tomorrow! and they gave us 3 days to send the letter back!! Snapped their hands off!! Sent acceptance letter back yesterday special delivery so will get that this morning!!
