Andrew1...have only recently looked at my credit report and Cabot Financial registered a default with me even though Kingshall No 1 started the court case. This is getting so twisted with a bit of luck we'll have a public hanging for Cabot etc..

Just checked it again. Yep it says Cabot Financial (Europe) ltd. This is just Experian I have to look at the other two. But what the heck is going on? If, by their logic, they are saying King's Hill own the debt then King's Hill should be registering the default. They claim Cabot is just the admin arm. Bizarre!!!!

Now this is getting interesting... Why have they suddenly switched from using Kings Hill (No.1) to Cabot Financial (Europe) Ltd....

 

Have they realised, what they have been doing and the mistakes they have made ?

Are they now trying to rectify it ?

 

If Kings Hill (No.1) were the owner of the debt, I would ask for proof that it has now been sold to Cabot Financial (Europe) Ltd. I just tried to check my file with experian, but it says the site is down... I'll check mine later and see if mine has changed from Kings Hill to Cabot Financial

Now this may have always been registered as Cabot when they took over late 2005. It's just that I have only just checked the file so don't know how long it was there. However I did think the same perhaps they realise they aren't doing this properly. But they're still not. All it does is open yet another worm filled can re King's Hill. You're quite right. When did they sell the debt to King's Hill then?

Well it's Kings Hill No1 who have been reporting our data monthly since back in 2004 and they still show as the people doing the deed in Dec 2006!!!

 

Not bad work for a company with invisible staff????? :D

eevnin all ! Interesting developments caboteers.Well done. Takes me to a post earlier in this or another Cabot thread at the time when I was speaking to the Credit referencing agencies.

 

I'll check it out tomorrow, but Either Experian said Kingshill was their client and never heard of Cabot or it was Equifax, I think I made note, but both contracticted one another. That might just bear out what you've said Rhia and CAbot actually are registering defaults too.

Good progress Tbern. I have been away in Tenerife enjoying my Bank of Scotland refund so haven't been reading.

 

when I got home I had a letter from Mr Spencer. In it he aknowled that we have a court date for 31st Jan and that am I sure I want to proceed against Cabot Financial Debt Recoveries Ltd as this is the wrong company. If I intend to continue they will ask for it to be struck out.

 

point 2 was that I would probably need an expert to explain the damages calculation. I am happy for the court to assign damages, they are not the main reason for my claim.

 

point 3 that only the diputed account that has not been settled is in question as the other 3 are settled. So the Data Protection Act breeches don't apply because they have settled? The settled accounts were paid and I have never had it proven that any of the Cabot group had the right to chase these debts so, sorry but I beleive they all stand in my opinion.

 

Its getting interesting now.

Tell me, what made you go for Cabot Financial Debt Recovery services Ltd? I know they own the full shares in both Cabot Financial Europe Ltd and Kingshill No1 Limited - but why go for them?

My thinking at the time was that they owned both of the companies doing the damage and that it could help shed some light on the handling of the overall group.

 

Since then it has come to light that Kingshill have no employees (so who would I be taking to court)? even though they do say they own the debt. Also who is the data controller but the nasty calls and letters and were being done by Cabot Fin Europe ltd who should not have received my data.

 

I have m case management meeting at the end of the month and worst case I would just have to resubmit my same paperwork on either Kingshill or CFEG. I will take copies of both POCs ready for submitting while I am at the court.

 

They have also defended the claim and have instructed a solicitor so I would be argueing that they obviously beleive they have some accountability??

 

Any advice would be gratefully received.

You should ask him, what kind of expert ? Isn't it a little late in the day for Hodsons to start acting like a firm of solicitors ????

I perhaps shouldn't take the mickey out of them calling an "expert" at the end of the day everybody is good at something?

 

I just remembered my Grandmother always used to say " a drip under pressure" if she ever heard anyone calling themselves and expert of something (electrics, plumbers, mechanics, gardeners etc..) My Grandma was a funny lady - had and answer for everyone!!
