I went into court today for a claim using unauthorised rate. The defendant didn't turn up (surprise surprise). They have sent a letter agreeing to pay the whole claim, all the interest, costs PLUS S.69 8%. I never asked for the 8%, so that was nice of them, it must be that gesture of goodwill they were on about :D

The hearing lasted about 30 seconds. The judge asked "you didn't expect the defendant to turn up did you"? "you will get whatever you ask for because to defend it, we require that they reveal their costs, and they won't do that".

 

They pulled out my short & curlies once, now I have theirs..

No, this was a hearing for directions. The judge said if they don't pay within 7 days, contact the court & they will issue a hearing date.

Their offer was not made without prejudice, and their failure to attend today, without an explanation will not help them at all..

Sorry to be a MOANY so and so But could we keep this thread on Topic with Legal arguments and Angles for claiming Authorised/unauthorised CI please by all means link to your claim if you think there is something relevent in it but please dont start discussing it in here it is what has happened in other threads in regards CI hence this thread to try and make it easier to see the different angles to approach it from
