      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Tori, i am confused, the letter i got from the court said they had 28 days from being deemed served. That happened on the 15th April and they acknowledged on the 17th April, so i thought they had 28 days from the 15th April, which gives them another 24 days,

I am going to read the FAQ section again.

 

 

I hope you are correct, that would be cool if they had 14 days from acknowledgement, as that would mean only 12 days to go.

 

Lets hope you are right.

Caz,

you file with MCOL

allow 5 days for it to be served.

They then have 14 days to acknowledge it.

THEN

They have 14 days to submit a defence.

 

so if you go by 33 days from the date you filed on MCOL you wont be far out.

sorry caz mis read your posting,

because they have entered their defence BEFORE the 14 day deadline this moves things forward, they then have, as Tori says 14 days to defend. [17/04/07 +14 days]

Hi Caz sorry to confuse you, hope what dar3n said makes a bit more sense!!!:-) They have 14days to submitt a defence after they 'Acknowledge' the claim.

So its 28 days from when the claim was 'Issued' (which should be on a letter you recieved from the courts) to when they enter a 'defence', But they Acknowledged your claim in record time!!!

Oh my goodness, that was all very confusing and very entertaining to read, lol. I think we all went around in circles for a while there.

 

So as they acknowledged as you say in record time, being only 2 days, they now have 14 days to defend.

 

Right, i have a copy of the letter i received from the Northampton court.

 

It says that

 

An acknowledgment of service to your claim has been filed today, a copy of which is attached.

The defendant now has 28 days from the date of service of the claim form to file a defence.

 

 

The date on the acknowledgment of service is the 16th April.

It was deemed served to them on the 15th April.

 

This is all moving very quickly.

I understood they had 14 days from the deemed served date to acknowledge and that Barclays normally take the full 14 days. Well they didnt so that is what has confused the issue, they litterally did it in one day.

 

Help Please, we are all still going around in circles here.

I just telephoned mcol and they said that they have until the the 14th May to file a defence, and i should look on the web site at my claim on the 15th and see if they have filled a defence.

So, what the ruling is.

Is ACTUALLY 28 days to defend regardless on whether they acknowledge early or not.?

Is it just me or the law still seems to lean towards favouring them???

ok cool, dont worry at least we all know what is going on and where we are now. So still 24 days to go...........

 

And yes it all seems to be in their favour, after all they seem to be allowed to defend late, but i bet we wouldn't if it was the other way round.

Just checked my mcol on line and no defence yet, so only 19days to go,and then the fun really begins.

19 days seems like an eternity.

I am not good at waiting, but i guess i have no choice, so i will keep you all informed.

knowing good old barclays they will defend at the last hour. just the way they work. (seen it loads of times on here! and with my own claims)

 

just play the system you will get your money back but not until you receive your court date, but having said that a nice bunch of people in litigation so the end bit will be easy. :D

 

patience etc ;)

 

just to add they paid out on a similar site to this a whopping £29,000! claim! (and this was a normal account not a business one!) :D :D
