This is my scenario:

 

Originally debt with c/card forsay £3,000k.

 

Sold on to debt collectors.

 

Am contacted by DCA offering settle for £1000, but won't remove default.

Take them up on offer. They advise, at start of call, telephone calls may be recorded blah blah..

 

Then go to original and seek refund of charges. Sorted, you receive £800 or so.

 

Problem is account is settle now, and original c/card company no longer controls default, not in their name but in dca's name.

 

How likely is it that dca had recorded that phonecall, for instance if i said you agreed to remove default, but i see its still there?

Down the line in a hypothetical situation if it led to court would they bother defending it?

Charges claim nearly sorted, now taking on anything thats left..
