They got away with cause they had tried to settle,which the judge was happy with. chap representing the Clydesdale was only a clerk, working on behalf of the Clydesdale form Birmingham.bit clue less but ameniable. did not have any instructions to go on,

 

it all went a bit fast, could have done with abit more time.

Obviously CB thought there man was going to be sacrificed so they sent some poor clerk instead of a company lawyer. Hope you sort things out soon, sounds like a bit more paperwork and you'll be there. How long was the adjournment for.

judge needs my ex's home address to add her name to the order, i said that i could get this, not so sure at the minute,

 

i do have the cheque for the full amount, i need to speak to my ex and she if she is going to be reasonable about this!

i have a new court date on Friday 2/3/07, as the judge had ordered that my ex be added to my claim, i have contacted ex, on the first phone call she was pleasant and agreed to sign her half away, as she never used the account and it was not in here interests to have half,

 

she ignored all of my emails and most of my texts, but have spoke to here on three occasion's she called me, with different outcomes on all three times,

 

now the court date is on Friday i text-ed her again and to my surprise she text-ed back, stop contacting me, which i asked why she replied the same again.

 

now i have to go to court with no idea what if anything she has done.

I guess you don't have a choice then but to comply with the court. It's a shame you can't get the case heard properly on its merits rather than a technicality. All you can do is take copies of your correspondence with her, and I suggest a written account of the phone calls signing to say that it's a true record. PM me if I can help.

Can anyone tell me if i can do a claim online against yorkshire bank or do i have to go through the paper route??

As long as you are claiming in England or Wales and your case is straightforward you can do a MCOL. Read the FAQ's, start your own thread, and make sure you keep your claim and any correspondence to an English address, rather than HO in Scotland.

i attended court on Friday, no sign of my ex gf, so the judge ordered the Yorkshire bank to pay the full amount out to me in full, and if she does come into the picture at a latter date she will have to sue me for half, thanks to all who have help on this especially Caro, thanks.

still no sign of my payout, YB was order to pay me within 7 days, now on day 8,is it working days? also when i received the court order from the court the amount was incorrect in my favour by around £20.

Hi alymac an order is an order, you could phone them on Monday morning reminding them of this, if they fail to pay issue a warrant and send the baillifs in.
