      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I am claiming just over 4k's worth of charges .... termed 'total charges' Here is a their latest letter to us: We wondered whether of not anyone else has had a same-ish response and what advice there is as to what to do next? .... We're thinking maybe to head straight online and sue ???? Thanks vm.

 

"Thank you for your letter requesting a refund of business charges totalling £££'s We now ask for clarification as to which charges you were referring to.

 

The "total charges" as shown in the statements comprises various charging components, not all of which are claimable. You will find the detail of these charges in the Pre-Notification advices which were sent during the charges period in the claim. I have ordered copies of notices for you and these will be sent to you. These notices will show a breakdown of the charges in question. If you wish to pursue your claim please write to us with a schedule in the format date/amount/type of charges. This level of detail/information will of course be required should you decide to take matters further.

 

For the sake of clarity, any claim received at this office that includes debit interest will have this struck out and / or the claim rejected as this may not be included at this time.

 

I would also remind you that the contract between the bank and its customer is governed by our business banking t&c's. In respect of overdrafts, I would refer you specifically to clause 8. The circumstances in which these charges apply are clearly set out in the T&C's and the level of charges is stated in our published price list, both of which will have been provided to you when you opened your account. Additional copies of your T&C's and our price list can be requested from our branches, or online.

 

If we do not hear from you again within the next 8 weeks we will consider matters resolved."

Can anyone help me? I've looked and can't see anything related to my query.

 

I have made a claim against HSBC for £4911 and received an offer for £3500. I know I'm not to accept it but I have a problem. Unfortunately mainly thanks to the service from the HSBC I have had my overdraft transferred to a Debt Collecting Agency and the HSBC have said that any money owing to us would be used to pay off the debt which would leave us with nothing. Can they do this or is there a way round it?

 

Please help I really need this money.

I am in the same situation, due to poor management my account spiraled out of control and in the end they passed my debt to Intrum Justitia. I am in the process of claiming almost 5k in charges.

 

In all my corrospondance I have mdade the point of any repayment should be made to me via cheque, I suppose I wont have a leg to stand on if they decide to pay it all to intrum jusitia but I have an agreement with them to pay £100 per month and any charges I get back I want to use it to clear other debts.

 

I am just going to stick with my "payment to me via cheque" route and hope it pays off.....its worrying that I have not seen anyone get a cheque paid if the account they are claiming from is with a debt collection agency.
