Can anyone help please. I Issued a SAR to Capital One on 1st March. It was signed for on 2nd March 07. I have today received a Default Notice saying "Notice of Default served under Section 87 (1) of the Consumer Credit Act. You have breached your Capital One Agreement limited as described in clause 4 of the agreement. This is for going over the limit. (I think there is a joke here somewhere). The amount in question is £134.00. I am sure that my charges will be more than the debt. The only thing I am concerned about is that the default notice is not shown on my Credit History.

 

What course of action do I follow.

I had actually read your thread yesterday when I received this default, I have sent off the reply letter today. Can't wait to get started on them, I am sure I will clear my card with what they owe me.

Not yet. I passed mine to the FOS. So far Cap One have offered 577.00 which was better than the 208.00 initially offered. However, the charges were £605 and the balance on the account is £627.00 so I am holding out.

Good. . i have found the Ombudsman route quite quick. As it's a Credit Card claim they will follow it through.

Well, I've accepted CapOne's final offer via the FOS, which is about £200.00 less than I initially asked for but that was with CCI so I am happy to settle at this figure. It does mean that the account is now clear and I get a cheque for £238.00, so I will make a donation when I receive my cheque.

Thank you all - I too hope I get my cheque soon. I'm just so glad to get Cap One off my back the rubbish that I have received was laughable in the beginning but it got that they were really stressing me out. Even after the FOS asking them not to contact me until negotiations were over they still carried on writing.

Cheque arrived today. I realised the other day that Cap One had credited my account with £208.00 the amount that they initially offered me which I turned down. So thank you Cap One as I finished up with £208.00 and £426.00 which they paid off the account + £238. Plus I had the pleasure that it cost them £400.00 with the FOS. Well worth the time and effort. So I was only about £100 short of what I asked for.

 

Donation when cheque cleared next weekend.
