      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A few people have had this happen. Does your account show a credit balance? If so say you want to close your account (but if you dont want to close it then dont say this!) and have the balance sent to you in a cheque.

 

Think it is time to get firm with them!

Hi there innocenti :)

 

Studio have credited me only part of what they owe me,so i'm not quite in

credit :( ,I would be if they gave me back all of what they owe me.

 

They also just went ahead and credited my account,when i asked them to send me a cheque!! :mad:

 

I received a letter from them this morning about the PPI,the thing is even if i take off the PPI the amount they owe me still works out more

than what they have offered.

 

Not sure if i should waver the PPI? I don't remember agreeing to it tho. don't know if i should send em another letter saying , just pay back all the other charges,or should i just hold out for the whole lot??

The PPI is a grey area. I was never charged for it but I am not sure why. I might have declined it when I set up my account. I am not sure if you can claim it back as it is in theory not a charge. But as you say, you never asked for it. But like I said it is a grey area.

 

If you owed them money they wouldnt have sent you a cheque, they would clear your balance first. I had the same done to my credit card.

 

Not sure what they are doing by not paying you all that you have asked for. Maybe they know they dont have to repay PPI???????

 

Send them copies of your statements with the charges highlighted and ask them to pay the remainder. Hope fully that should work! :)

This thread is great, I am just about to start a claim with Studio.

I have received my statements in ultra quick time!

 

Did anyone claim for the service charge? They already claim interest, seemingly the service charge is the interest on the order??

I might claim and see what happens.

Any advice much appreciated.

Hi Alison

 

I claimed for the service charge,I've nearly got all my charges back :)

The only thing they get a bit narky about is the Payment protection charge:mad:

 

I must admit tho,they are really quick in paying up (which is nice) I got my GOGW really quick.

Make sure you let them know how you want your money back,they credited my account,but I have asked for the rest to be sent to me by cheque,which is taking a bit longer.

Hello All,

Boy am I glad to see this thread. Visited my mum today who asked me what she should do about her studio account. OMG her charges are extortionate. I said "leave it with me pet, I'll get it back". Now I just need to make sense of her statements.

What is Service Charge?

She doesn't know either but pays approx £16 a month. Looking at above thread looks like she can claim it back but would like to know a bit more before I go in with guns blazing.

Dont mean to hijack thread. Just the question I promise!

The Service charge I think is just like a handling fee. I claimed for this and they haven't disputed it.As I have said the only thing they get funny about is the payment protection.you wont have any problems with studio,they pay out very quickly.:) Like you I was really shocked at their charges:mad:

But I've got most of mine back in a GOGW, I'm sending em another letter on Tuesday asking for the rest,as you have probably read it hasn't taken me very long to get this sorted.

 

And the address in your thread was correct.:)

PLEASE PLEASE HELP!!

I am a exsisting customer of these unfortunatly and have probably be charges hundreds over the years.

Can you expalin if its admin and service charges I,m looking for.

I,m new to this and am finding it hard to understand alot.

Heres my first letter:

Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

 

Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.

 

If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

 

I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 DPA subject access request fee.

 

If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

I'm back!!:)

 

Right once you have got your statements back you need to check for service charges and your admin charges,these are what you will be claiming back :)

the only thing i wouldn't claim for is the payment protection,this can be a very grey area:rolleyes:

 

Not sure if you can claim back the £10 fee,i was told that they didn't charge for the statements and they credited it to my account,but it's best to pay it anyway.

 

The letters that I sent are all available in the cag library

Ive had to change my name as Ive had some logging in issues and for some reason had to register.

I sent my letter plus £10 and they've cashed it within a few days hope their that quick at giving it back to me!

Ive heard their very hard to get your money back, but maybe with your help I can make them.

Sorry, didn't read properly and this has already been answered.

 

I sent a prelim to studio caliming over £400 which includes service charge and admin charges.

They have sent me a chq for £114 and cleared by £86 balance 'as a gesture of goodwill without prejudice etc etc.' for admin charges charged on my account.

 

They have not paid me the 'service charge'

Should I sent the will accept this as part payment letter??
