Moneyclaim timelines

I just wanted to let people know what I have just been told by Moneyclaim.

 

It says on the site once you have filed your claim, the bank have 14 days to acknowledge/file a defence/ask for an extension etc, and if they don't we can file a judgement against them.

 

Moneyclaim have advised me that it is actually 19 days. You have to allow five days for them to serve the notice (and this starts from the date on your notice, NOT the date you start the claim on the website) then the further 14 days. If the 19th day falls on a weekend or bank holiday the judgement can be served on the next working day.

 

I also wanted to mention how helpful they were. They said I can call them every day if I like to check on timescales/ask questions etc. They really put me at ease and this whole process hasn't been nearly as daunting as I thought it would be.

So if my claim was issued on 27th April and they have not acknowledged my claim, then I should be able to start a judgement today - yes? Because I can't!

 

Have I missed some vital information? Have I forgotten something?

The 19 days would end today - maybe try tomorrow.

Thanks... have been waiting until 5pm today to start the judgement and then aaaaaaaaaaarrrrrrrrrrrrrrrrrrrrrrrggggggggggggghhhhhhhhhhhhh!

 

Think I will try again tomorrow and then call if I don't have any joy

Defendant has 14 days from Service which starts a couple of days after issue, my 14days where up on the 8th but could not apply for judgement until the next day (9th). if you apply for judgement before 9 am they will issue that day at about 4pm ish, if you apply after 9am it is issued the following day.

 

your online status detail get update at about 5pm so it should change from Judgement Reqested to Issued
