      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Can you help thick Mrs Phatram please? Downloaded "Throughout Claim with Compounded Contractual Interest" spreadsheet to work out info for Marbles Credit card.

Input charge amount into column B, Date in column C & the interest rate of statements in column D. Never having even seen a spreadsheet before - what do I do now? Beginning to feel very stupid!!

Thanks for your post. I have changed all the details - date, interest rate & personal details so the sheet has columns a,b,c & d complete - plus I've deleted all the xtra rows. What do I do now? I know this probably sounds really dumb but never even SEEN a spreadsheet before!!!

Mrs Phatram here cos Mr is thick and getting angry.

when the Excel advanced spreadsheet for Credit Cards comes up it has figures on it already. I add my name, bank & details etc, that's fine. Do I then just leave the figures under "total Claim", "Total amounts""total penalties" etc as they are? I put them back to "0" and it has not tallied them up - was this wrong? Getting the hang of it though!!

Hi, Mrs Phatram here,

Just completed my spreadsheet for my MBNA claim, using sheet 13 as I have no balances. As no interest rates were included, I 'phoned MBNA to ask what rate was being applied to my account as of today's date and they told me 27.9%. My charges are going back to 1996, totaling £562.00, the interest figure given is showing as £1956.52, giving me a total claim of £2518.52!! This seems very high for the charges made - what does anyone else think? Please advise!

Hi Mrs Phatram here!

About to start compiling my spreadsheets for Co-Op Bank claim. I am a little confused by Column H. How do I find out the average, and during what period? Secondly, Column I, not sure of what authorised O/Draft we have had & when it has changed over the 6 year period. What should I input? I'm using Vampiress suggested sheet (advanced).

Hi there

Starting to fill spreadsheet no 5 (Bank charges England). Am I right in thinking I do not have to put anything in columns D, E, J & K. Also in column G, do I put in the interest rate, or do I leave it blank for the spreadsheet to calculate the interest charged?

What would I do without your help?!! Still can't work out what to put in column G. I don't know what the interest charged is my bank statements don;t say - does it tell me somewhere else, or does the sheet calculate it for me? Sorry to stress you, but O-Level maths seems a LONG time ago!!!!

when I copy one of my old ones and clear it to start again it doesn't add the interest.

I've tried one of the other spreadies but it has interest @ 8% and I don't know how to change it !

Errm... I'm attempting to calculate compound interest on a credit card, but none of Vampiress' sheets are up - they are 404'd. I have spent a lot of time on the forum looking for alternatives, or alternate locations but cannot find any. Can anyone help me out? Cheers.
