Had a look through my statements, was so annoyed to find I was charged £25 over limit charge for being £6 over my limit. The next month the £25 charge put me £4 over the limit which I was charged for again, then £20 over, then £6 over...

 

Absolutely fuming so I might as well make MBNA the 4th bank on my hitlist and tackle all of them at once.

Recieved a reply today, "We have sent your complaint to the correct department to be investigated, and we will reply within 28 days, blah blah."

 

LBA on the 22nd! Just hope they don't call in the £4k balance because i'm claiming back £125 in charges!

don't worry mate, even if they do that you can make a payment arrangement which won't affect your credit record or even better would be if they issued proceedings or counter claimed because you would probably save money in interest once again without it affecting your credit record and you would probably pay less each month this way anyway

Cheers SS, thinking about it that way it would probably be better if they did call it in! £4k @ £100 a month with no interest would make a big difference!

Have a look at my post I updated today. They refunded the acount for £510 3 days before the LBA deadline.However, I had set a DPA deadline of today's date which is the reason it came today so you can probably expect a letter on or just before your deadline date.

Received a reply to my LBA today, exactly the same reply they sent to my prelim - 'we will contact you within 28 days' etc etc. Looks like it will go to moneyclaim.

Same happened to me m8. I got three timewasting letters to take me past my original deadlines. They finally responded to mine two days before their deadline for acknowledgement of my moneyclaim claim.

 

Just stick to your deadlines and move it onto the next step if they chose not to respond within your timeframe.

Have just sent a reply saying 28 days from receiving my LBA isn't good enough,and by the 6th June I will have given them 28 days in total anyway. Unless the whole amount is in my account by 9am on the 6/06 I will start moneyclaim proceedings.

 

That's the jist of it, it possibly won't make a difference but it won't hurt to give them another nudge, and I quite enjoy writing these letters now :)

Well my letter was delivered today, i've just checked my account and £110 has been credited. Not bad, but I did specify I want the whole £150. What they are messing about at I don't know, if they think I am happy with that they are wrong. I'll send another letter monday stating I want the other £40 returning by 9am thursday.

Dear Mr Bailey

 

Thank you for the refund of £110 to my account. However I did specify that the full amount of £150 must be credited to my account to avoid further action, therefore I do not accept this as a full and final settlement.

 

I believe these charges are unlawful and I am more than willing to prove this in a court of law should the need arise. Therefore unless the remaining £40 is credited to my account by 9am on Friday 09/06/2006 I will commence legal action without further notice.

Well i'm off to Germany for the World Cup early tomorrow, the deadline for them to refund is 9am and I haven't heard anything or gotten my £40 back yet. Maybe they think I won't lodge a claim for such a small amount - how wrong they are. Unfortunately I can't do it until I get back but it'll keep :)

Well I have returned to a letter from MBNA saying they have lowered their charges to £12, and if I still don't agree to them they will withdraw the card from me. So if I send a letter refusing to pay £12 a time charges can they default me (bearing in mind I'm not behind by any payments at all) or would they just have to accept a reasonable amount from me - my current minimum payment is about £85, now if my card was withdrawn and I could pay this amount every month with no further interest charges, that would be great!

 

So what could they do if |I refuse to accept £12 a time charges?

They can close your account and ask for the outstanding balance to be repaid. I have to admit that I haven't heard of a credit card company doing it, but it is always an option to them.

So let me get this right, they still owe you £40 but they have written to say they are reducing the charges to £12 ? Haven't they forgotten something, that they still owe you money ! What's the latest on that front Rob ?

 

I haven't received a letter saying the charges have gone down, does it have an effective date on the letter ?

Hi mate, Germany was great thanks - I really didnt have time to look for an Internet cafe while we were out there though, and only got back saturday so nothing else as yet on the £40.

 

The letter about the charges being reduced to £12 was dated the 8th june and says it will come into effect from my next billing date.

 

It also says on the bottom - 'if you are unable to meet this request and wish to discuss the matter further, our specialists are available on 0800 731 2262'

 

The letter is signed Matthew McGrath, head of customer assistance. I'm very tempted to write stating i'm not willing to accept £12 a time charges.

I'm not bothered about losing the account, it very rarely gets much below the limit and it seems like a black hole that i'm throwing £100 a month into! I realise they will ask for the whole amount which I don't have, but I would be willing to pay them more than the actual minimum payment would have been on the account 9say £100 a month) What do you reckon they will say to that?

 

If it goes to court they will get nothing from it, if I had to fill in an expenditure form the mortgage, bills, loan etc will take up nearly all my earnings and there's no way they would make me pay more than £100 a month. Obviously it would be preferable not to go to court, I just wonder how likely they are to do it.

depends how much you like your credit rating and how good it is ? you can get them to freeze the interest on your account, they need to show willing to assist you as it only helps their cause if it ever does end up in court that they have tried to help you. Speak to the advocates office and get them to do that and make sure they confirm in writing what you agree. Lay it on quite thick. To be honest though mate, they will let you pay over 10 years if you like with no interest which so as opposed to paying £100 you might get away with something like £35 (based on 4k)

Well I don't know if MBNA read these forums, but I got another letter today. 'Terms and conditions, charges are clear and transparent, blah blah, however we value your custom so have refunded the extra £40 as a gesture of goodwill'

 

Cheers MBNA if you're watching, saved us both messing about with a court claim for £40 (which I was ready to do)
