      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As you would expect Livelylad is completely correct, by pushing further, I believe what is meant is that Lloyds will look to offer you less than half or nothing at all.

 

There is absolutely no point in reducing any of your claim at present, it could be construed as a sign of weakness and in any event why would you want to concede anything at this stage, it is your money that they have taken.

 

Lloyds have a strategy for claims and so do we, we should stick to ours and they will stick to theirs. Ours involves claiming the full amount plus interest, taking the legal steps per the FAQs etc. (in this site) and Lloyds' strategy involves delaying and denying everything and eventually settling in full prior to the hearing.

 

However, I firmly believe Lloyds are changing their strategy and settling earlier, as the courts are becoming increasingly impatient with Lloyds' litigation strategy.

You either go no response, or as good as no response with nonsense words that say we are right, you are wrong, therefore no refund of charges.

 

With Lloyds you nearly always have to commence proceedings. However, they have been refunding as a goodwill gesture £750 lately (irrespective of the value of your claim lately). Hopefully they will give you a refund so that you have funds for the court fee.

Providing you file on line and in case you are not aware send 2 copies of your schedule of charges, clearly marked with your claim no. and a brief covering letter asking for them to be filed with your claim to:

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Yours faithfully

 

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

 

Dear Sir,

 

(Your Name) -v- (Bank)

Date Issued: xx/xx/xx

 

 

Please find enclosed a copy of my schedule of charges relating to the above claim.

Do i send the N1 to the court who sent me it (which is my local small claims court) or is there a main office it has to go to?

 

Im hoping to get this sent off over the weekend or monday but once the court receive it i take it they send me a confirmation they received it? and it says in the leaflet i have the court then send a copy of the claim form and a response pack to lloyds how long do lloyds have to respond?

 

It is best to ask the court to serve the papers on Lloyds. I sent a letter covering my claim form as below to the court:

 

'Please find attached 3 copies of a Claim Form and Particulars of Claim in respect of the above matter. Additionally attached is a cheque for £120 made payable to HMCS to cover the court fee for commencement of proceedings.

 

Please will you issue the Claim Form and serve it with the Particulars of Claim on the Defendant and return the Writer a sealed copy.'

 

Lloyds then have 14 days to file an Acknowledgement of Service from the date the claim form is deemed served, the court will tell you the specific dates in a Notice of Issue with a sealed copy of your N1 usually within a week of you filing at the court.

You tried to send me a PM, but my in box was full, empty now. I presume you wanted me to look at this so I have.

 

5a) is just the charges and not the interest.

 

You need to deduct £135 from your total charges. Deduct this sum from the most recent charges so that it has the minimum effect on your interest. Show clearly that you have deducted the £135, in case attempts are subsequently made to take it again by Lloyds.

 

Remainder of particulars are fine.

Dispensed means, done away with, in theory it should speed matters up. You usually have to pay the £100 if your claim is >£1.5K, check when you phone the court.
