Yes! My first success!! It was all quite painless really too!! As soon as the cheque clears I’ll be donating to CAG, of course!!

 

I followed the formula as set out here, firstly with a S.A.R. This brought the usual “Thank you for your complaint” letter with the expected b******t about how they didn’t agree with the OFT’s decision etc., etc. However, tucked away in the letter was the ‘nugget’ I wanted to see - £250 had been credited to my account as a ‘gesture of goodwill’. I took this as an indication that they would capitulate one day.

 

I was tempted to ‘phone them but, not having recording facilities (at the moment) and wanting to have a record of who said what and when, I wrote back (Recorded Delivery, of course) and politely pointed out that (a) they had not complied with the Data Protection Act insofar as the information they sent only covered back to 2003 and (b) I was accepting the £250 as a partial settlement of my forthcoming claim.

 

Just before Christmas the remainder of my S.A.R. was complied with and I received statements going back over six years together with an apology for their ‘omission’. I spent some time compiling a spreadsheet (thanks Vampiress) and arrived at a figure of £800ish as the amount ‘taken’ in fees, charges etc. This became my minimum goal!

 

Early this month (and totally out of the blue) I received a letter from MBNA ‘upping’ their earlier offer by almost another £600. Taking the two together they had exceeded my ‘minimum goal’ by £40!

 

I spent a few days debating whether to accept this or go for the interest as well! The prospect of an ‘early bath’ was too tempting though and I was getting more back than they had ‘taken’ anyway. I accepted and received a cheque this morning!!!!!

 

As far as closure of the account is concerned, yes, it’s happened. However, this was done at my request very early on in the proceedings (at the time I wrote back ‘rejecting’ the initial £250). The account had a zero balance anyway and it’s ‘loss’ does not affect me at all.

 

I will just add that I think my comparatively easy success was partially due to (a) my wish to keep everything in writing and not being tempted to use the ‘phone and (b), consciously remaining very polite but firm in all my letters.
