Wouldn't it be great if they defaulted on a CCA, for example, we could file a default against them.

All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

I would like to add my £0.02 here

 

Lowell - entering a default on credit record without being able to substantiate, etc. and "sly" tactics as in sending through the post a "sorry you were out" style postcard to try and infer somebody has called. I'm sure many people have these.

 

Experian (in particular, but for that matter any so-called "credit reference agency") - for accepting on face value the word of a shark, third-party "for profit" DCA and entering credit information available to banks, financial institutions etc which has not been verified and not capable of being verified, and will not lift a finger when formally disputed.

 

I would love to see a mass "class action" against the companies/institutions/organisations that do it wrong.

These CRA's are a lousy bunch - it's hight time they were taken to task for their cavalier attitudes in reporting erroneous data etc.. - they don't care whose lives they are wrecking at all do they?

 

Surely there are sections of law we can use about these people ?? (I am sure I read some stuff on here) I reckon a few of us ought to start complaints and give these companies something for their troubles!!! :D

I totally agree, adding defults all over the place from sources with no evidence of a debt other than their say so, and now, with the law changes on bailiffs and enforcement, they really need to be squeaky clean and only acting when necessary or a lot of people will be getting visits for things incorrectly, as they do now but with much trauma all round.

Asset Link- bought my debt, refused to negotiate payment and are taking me straight to court with the intention of obtainig a charging order. Oh and they very nicely offered to 'put me in touch' with a company they deal with to organise a consolidation loan.

 

They're just generally rude.

Do you know how you will deal with the charging order? Im trying to get as much info as possible on this, it has not happened to me yet but EGG will not negotiate with me and i have read threads about EGG going for charging orders.

Thames Credit - phoning me up and offering to put me through to their "specialist loan department" so I could take out a secured loan on my property to pay their debt - a debt which I am still waiting for them to prove I owe (they have defaulted on my CCA request). A very rude girl who said they "don't take any notice of the Citizens Advice Bureau" and that I should be taking notice of what SHE said instead. Needless to say was sent off with a flea in her ear and told not to phone me again :evil:

 

Link Financial - for phoning at all hours of the day and night, trying different "personal" approaches to get me to engage in conversation with them. One member of staff who I won't name being extremely rude and patronising and telling me I "had no rights" and "should pay up" and that they don't take "any notice" of advice from the Citizens Advice Bureau. ... nothing more heard from them since my CCA request which his nibs told me I was NOT entitled to see and therefore I didn't need a copy of it!!! :evil: :evil:

 

Lloyds Bank - for sending a letter to a local DCA who then said they would be "coming round" to discuss my financial situation with me! After I told this lot to go forth and multiply on their own behalf ;) Lloyds then sent it to another national DCA as they knew they wouldn't get anywhere with their original approach ... not that the second DCA are getting anywhere either as they have defaulted on my CCA.

 

I also think there should be a law against all these companies making ANY contact by telephone whatsoever, everything should be put in writing ONLY. I refuse to pay call barring, so am just ignoring their messages and putting the phone down on them, but they cause so much distress with their phone calls that this should seriously be looked into IMHO.

2)Take the phone into the toilet.

3)Place it on closed seat, pull the chain and leave the phone in the bathroom for as long as it takes.

 

They haven't rung for ages since I did that.

Hi I found that putting phone near to tv speaker seemed to stop calls for a week( found out after that caller had logged on their system what I had done and made log to call 7 days later to see if I would do same again.)

I did and DCA passed account back to Capital one.

Just subscribing as I have 7 live ones and a possible few others from the past I would like to report in this mass complaint!

 

Awaiting to see if any default/commit etc and will add them.

 

But the demons are:

CapQuest - this lot were the worst to me

Lowells/Hamptons Legal - very close second

maybe Cabot, who were not too bad with me, lets see if they default

Frederickson International

Bryan Carter & Co - improper CCJ bar stweards

H L Legal

1st Credit

 

I could dredge out things like Mr Holliday @ Halifax Credit Finance Dept who said "I will break you". Nice man, never forget him.

Vampyra I could do the same as you with the Mr Personality Bypass from Link who laughed when I said I had taken advice, asked where I had got the advice from, (it was on here of course) and when I refused to discuss and said he would be receiving contact in writing, he said with derision "well we won't be taking any notice of it" ... obviously not since they have now defaulted on my CCA ;):D

I'd like to nominate Lowells. They bought an alleged debt and despite their letter saying they want to help (haha) they were rude, aggressive and threatening on phone. Totally ignore anything you say to them in letters, just continue with their ever increasing threats by letters. THEN..can't even come up with an agreement, just a tampered with application form...morons!

I am sure there are lots of Allied International posts but I am adding mine. I owe them more now than I did when they started taking my money due to interest charges. I told them today to sue me and that I am not paying them a penny more. I have been repaying my debt for around 5 years it was £390 odd and nows it's about £405! :mad:

Hello All

 

I received a misleading communication from AIC Allied International Collections a bright yellow postcard requesting payment in full the client name was listed as FAIRMILE PARTNERSHIP who i had never heard of so could not link this to any outstanding default / debt. Plus the word WARNING and no reference to the original creditor at all just a number to call.

 

After i rang them to query the info I was told the debt was purchased by them last year it relates to a default from 2002 Natwest credit card,

to make matters worse after my phone call they called to a mobile number that is used for business and not allways answered by me in person.

 

(As they could not contact me on the home phone as it will not accept calls from with held numbers.) Apparently they searched google and found the mobile number via a business entry - to make things worse the number they called was never registered to me in person it always belonged to my partner who had died just a matter of weeks before all this happened.

I rang the DCA to make a complaint asking to speak to a manager I explained & requested them not to call that number again.

 

The manager asked me for a number they could call me on so I gave them a fax number from yac.com after hanging up the phone the person rang the number I had given (which can accept voice mail or faxes only) which I receive in an e-mail. Needless to say he did not leave a message and I have received nothing in writing.

 

However my complaint was ignored as just a week later they called the number again only this time the call was taken by my assistant. I have since made a formal written complaint to the DCA & have heard nothing in response.

 

I have informed DCA to put everything in writing only supplying them with a the fax number. Still no reply since Feb 07.

Hi Golden Dragon - that behaviour of AIC is absolutely despicable :mad: I am pretty sure you could report them to the Office of Fair Trading and Trading Standards for this kind of thing. Have a good read through other threads on the Debt Collection Agencies forum.

Moorcroft are the one's I'd nominate.

Breaking the OFT rules on debt collection.

2.2b.

leaving out or presenting information in such a way that it

creates a false or misleading impression or exploits debtors'

lack of knowledge

2.2c.

those contacting debtors not making clear who they are, who

they work for, what their role is, what the purpose of the

contact is. (the woman told me they didn't have to comply with this because of the data protection act)

2.2e.

failing to provide debtors or creditors with information on status

of debts

2.3.

Those contacting debtors must not be deceitful by misrepresenting their authority

and/or the correct legal position. (moorcroft told me I had no legal right to contact Barclaycard and they could take action against me for doing so.)

2.6b.

pressurising debtors to sell property, to raise funds by further

borrowing or to extend their borrowing (told me I should take out a loan or borrow money from family to pay them)

2.6f.

pressurising debtors to pay in full, in unreasonably large instalments,

or to increase payments when they are unable to do so (I lost my job and informed them and asked for a reduction in payments until I got work -refused and defaulted the account)

2.8g.

failing to refer on to the creditor reasonable offers to pay by instalments (as above)

2.8k.

not ceasing collection activity whilst investigating a reasonably queried or

disputed debt. (have told them It's in dispute with Barclaycard but still phone/write)

The last one is also against Administration Of Justice Act.

That's all I can think of at the moment but I know there's more.

ROBINSON WAY

Letter alledging I owed £220 to Great Universal, despite never having a catalogue account and having never received ANY goods.

I CCA's them and they wrote back saying Home Shopping Agreements are exempt from the CCA!

I wrote back saying they were not under ANY exemptions in the CCA and asking them to provide proof of debt (ie signed delivery slips) within 10 days or P off.

I never heard from them again.

 

GRAHAM WHITE SOLICITORS- NEXT DIRECTORY

Another alledged catalogue debt for £73.

CCA'd- No response

Default Notice- No response

Now about to Criminally Default them.

All my knowledge has been gained from personal experience and the sharing of advice from fellow members.
