Hi Folks. I had originally joined this Forum to investigate claiming my Bank's illegal penalty charges back, and i'm learning as much as I can before getting started. However, I had a ratherstrange phone call yetsrday from a company called Cabot regarding an old account I'd held with Barclaycard. All very weird, as the girl phoned while I was cooking dinnier, asked a few "security questions" and asked me to hold for an advisor to speak to me. Having held on without anyone else speaking to me for a couple of minutes, it dawned on me that the call was probably just a ruse to confirm that I do indeed live where they think I do, so I rather angrily slammed the phone down and did a Google for their name. Surprise, Surprise their name seems to crop up quite a lot on here, and I have decided to fight them over this... once they actually bother to write or otherwise contact me again, that is.

 

As an aside, my dispute with Barclaycard is as a result of them "Pre-Approving" me for a credit card about 10 years ago. Just as I was going through a series of redundancies, and having a rather poor credit rating as a result. Apart from the obvious idiocy of handing someone in financial trouble a piece of plastic to dig themselves an even bigger hole, I'm astounded that they refuse to accept that they also should shoulder some responsibility for the fact that I ended up unable to keep up my payments. I'll be investigating how to claim some charges back from them too. By the way, I found out that Barclaycard used to hold a 15% stake in Cabot, so perhaps it's no surprise that I'm starting to be harrassed by these bandits.

The charges are UNLAWFUL not ILLEGAL. They can charge for their loss if you go overdrawn, or a late payer, but the real cost to them in doing so is very small and probably nothing at all as the computor does the work.We have to claim the charges back in full, as they refuse to give us the real cost to them if we do go over our limits, or pay late.

Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later. Our aim is to make you aware of your rights as a consumer, enabling you to fight back against unlawful bank, credit and store card charges. In the website you will find information on how you could get your money back

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen. You can claim back your charges, and a few are trying for the payback of Early Redemption Charges on loans and Mortgages.

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time.

Is there a difference between UNLAWFUL and ILLEGAL??? I guess it must be so. Just goes to show the need to be word perfect from now on.

 

Thanks for the welcome, and I hope to begin the fight early in the new year once I have had a good search through the site. I'll update my progress in the Forum.

 

Which makes me think... could anyone use the postings on here against you if things went to court? Or is it quite OK to publish ongoings prior to any possible legal action?

We do have to be careful with the wording on some posts. It is all monitored by the site and the banks.

 

Unlawful means... contrary to, prohibited, or unauthorized by law...while necessarily not implying the element of criminality.

 

Illegal means ...against or not authorized by law.
