Hi all,

 

like you I have suffered outrageous bank charges at the hands of the Halifax but today I had a very reasonable chat with them and they have agreed my claim 3,000+ in full. They had offered me 600 less than my claim but 1 phone call later they said what will you take? I responded the full claim and they said OK?

 

Must say I feel a little deflated as I like a good arguement but I was denied that pleasure by a very agreeable lady.

 

Good luck with your claims, I hope you all end up as satisfied as I am!

LOL funnily enough I have just seen a Halifax vacancy in our local job centre :lol::p

 

 

Was it for a data controller ?

Looks like they may be needing one if they carry on breaching the Dpa !!

i have just rung customer relations chasing my claim before filing for court , and the guy said that they deal with them in the 4 weeks that they state in the letter so i made him aware that in a weeks time i will be doing it and what he said was they are now asking the courts for a further 2 weeks when they receive it , so it makes you wonder , is it worth leaving it for the 4 weeks like they say cause if this is happening it turns out to be 4 weeks anyway .

The court will not adjust the time limits just because the bank asks. the time limits are written down in the rules.

 

Set your dadlines and stick to them. If you give the bnk 4 weeks they will start asking for 6.

 

The 8 week FSA limit is their problem. not yours.

Don't give in.

 

How much leeway would they have given you when they told you they owed you money???

yeah this is very true , he said about the fsa but cant remember what he said , well i sent my spread sheets along with my second letter on the 21st , i got the normall will get back to you in 4 weeks , i have filled the mcol in and just saved it , when do you think i ought to do it , the 7th of march ?

UPDATE:

 

Well yesterday I posted my 3rd letter off to them. I hope they don't think that Im not organized because I sent it a week late - been a hard week this week, my father had a virus, less than 24 hours later he's in intensive care on life support (hence the week late in posting) he's starting to get a bit better so will keep fingers crossed.

 

Just hope halifax will just save the hassle and offer me the £1609 they owe me so I can stop worrying about that to.

 

anyway, as usual I will keep you all up to date.

Sorry to hear about your dad. I hope he starts to pick up fast soon,

I know how traumatic it is for you, like you say if haliprats just paid you so it is 1 less thing to worry about. Why dont you give them a ring if you get a spare 5 minutes and see if they will settle before court.

Update:

 

Got a letter this morning offering £954. Telephoned and spoke to Lynn (really nice actually) she said that she can not offer any more and I said I will accept it as partial payment and continue with the claim. She then said she will offer me £1500. My claim was for £1609, BUT I did accept the payment of £1500 - I think this was because my dad is still on life support and I just want thisd over and done with quickly, so I have lost £109 - but considering that I never had any of this money anyway until I found this forum - I can live with that.

 

So as far as im concerned, after the phone call agreeing £1500 which will be paid into my account within 14 days...

 

 

I HAVE WON!

 

I want to thank every single person who has posted and helped me to get where I am now - and if there is anything you can learn (if your just coming to this site and reading my little bit) is that you can do it - I never thought I would get £1 from halifax, and (hopefully) within 14 days im going to have £1500 - which will pay for the holiday I want for my mother and father together when he gets out of hospital.

 

NOTE: I feel if I pushed for the £1609 I would have been able to get it but personal trouble is more vital than the claim - so if circumstances wern't what they were - I probably would have got it - so you can to!

 

Thanks AGAIN to every single person on this forum! I will be donating once money is in account!

I am off to pick up my new car - paid with by the proceeds of my claim. Will make sure and give the local Halifax a beep as I pass them by!!

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it
