      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

High Steven, I have been with Brighthouse since they opened in my area abut 7 yrs ago. I finally sent my last item back 3 weeks ago as I was sick of there constant phone calls for one thing or another. Anyway could I still claim back the charges even though I am no longer a customer? They told my my account would still be active for 12 weeks after I returned my last item.

Our claim was after the account was closed. Go fo it. The charges were unlawful. Whether your account is active or not is not relevant to that. If you start a claim, start your own thread and post a link here so we can follow your progress and advise.

Thanks Steven I will get a letter typed up. I hate Bright house they have driven me mad over the past 6 months. ITV did ring me & wanted me to appear on a programme about them but I was worried about my family to be honest.

It was quite frustrating the way ITV dropped the Brighthouse segment.

 

I know for a fact that some sequences where actually filmed, and several people - myself included - where interviewed at great length.

 

In fact, ITV researchers used THIS very forum to find "suitable" people for the documentry - so with that in mind you may find THIS thread interesting...

HI

 

I'm new here and after some advice about Brighthouse. I've been with them for years, one of them things unfortunately. Anyway I'd ordered a Nintendo WII for my son for christmas. It was supposed to arrive weeks ago and never did. Was starting to panic as you can't get them anywhere and its getting so close to christmas. They phoned yesterday to say it was in and I went to pick it up. She said payment is due on it now, £11.98 I nearly fell over on there website its £6.49, or £9.99 (with optional service cover) I told her I didn't want the optional service cover as I had it with my setee and they never fixed that etc. And she said if I didn't take the service cover they wouldn't sell me the goods and that they also wouldn't let people buy them for cash either. So I've ended up taking the service cover but I don't want it. Is this legal?? I'm furious.

We can not sell it to you if you do not take out service cover. I said its optional service cover she said its at the discretion of the manager and on this item you have to take service cover, she also said she had tried to buy one of them herself for cash and they wouldn't let her.

 

So what can I do, it was a case of having to take the goods really as it is my boys christmas present, and Brighthouse know you can't get a wii for love nor money and they are taking serious advantage of this fact.

I have used brighthouse and found the service cover great and i was told it was optional and lets be honest if you have bad credit then you are going to pay more for stuff

 

Not everyone who can't get credit is a bad debtor, there are alsorts of reason why people can't get credit.

Why should you pay more for things just because you have had a bad time in the past, they are taking advantage of people on low incomes that have no where else to go & try & squeeze every last penny they can.

This is what I used (rather a long time ago, mind) with a couple of changes to reflect my current understanding

Dear Sir/Madam

My request

I am writing to ask you to refund to me the charges which you have levied since [date] on the agreements listed below.

 

I now understand that the regime of fees which you have been applying to my account in relation to late payment is unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put as a result of my breaches, in order to reassure me that your penalties really do reflect your costs.

 

Your responsibilities

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

What I require

I calculate that you have taken £xx.xx in unlawful charges. I enclose a schedule of the charges which I am claiming with this letter.

 

My targets to resolve this matter

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.

i have just come off the phone from having a heated discussion with a brighthouse monkey (employee), i reported last week that my touchscreen computer wouldnt work and could they come and fix it, the monkey (sorry employee) said he would get somebody round the next morning to try and repair it, and quess what, i waited in all that day, did they turn up NO!!!!, not even a phonecall, i made a call the next day asking why they didnt turn up and he said they would rearrange, so i said until its fixed i will not pay anymore payments. A week later, i get a phonecall off the same monkey, insisting i paid a payment, i refused point blank as i havnt been able to use to pc at all, it ended where i told them to come and get it and i,m finished with brighthouse, there was no apology at all, customer service is rubbish, all they,re good at is hassleling people for money. Is there a number for head office or a number ic an report them too. they get away with daylight robbery, i was paying £7 per week for this so called cover of which i did not want and they insisted i have. :mad2::mad2:
