DCBL snatched my pers phone over CCJ debt for Ltd Business debt - help

I had what I believe was an unlawful enforcement

 

it was carried out at my personal address but the debt was for a Ltd company that I am a director of.

 

to cut a long story short…..

 

I was outside my flat
 

The bailiff told me that he had instructed locksmiths to come and change the locks to enter my flat and take away possessions.

 

he then grabbed my phone and told me it was confiscated and now belonged to court.

 

without being able to speak to anyone to find out my rights I then paid the full asking money.

This I now understand included bailiff fees for stage 2 and for selling goods.

 

I have issued a complaint to DCBL and have also sent a EAC2 form to the court.

 

I m looking for 2 outcomes:

 

1. complaint to dcbl - to get the money refunded to me  for unlawful enforcement 

2. eac2 - For the court to review the conduct of the bailiff and decide if he is fit to carry certificate. (I would be happy if the court sanctioned him and out him through education on rights and wrongs)

 

Dcbl are refusing to review the complaint unless I withdraw the eac2.

 

is that a legitimate course of action from them or is it just blackmail?

 

also they are refusing to give me the video footage from bailiff body camera. They said there was a technical fault and the recording did not work.

 

any guidance would be very welcome

did you sign a personal guarantee.?

what was the debt?

and when did the claimant get a CCJ against you without your knowledge.

Hi there

there was no personal guarantee

debt was for a court hearing that The company lost (at the time of the enforcement I was in process of appealing) Debt was about £6k. Dcbl took about £3k fees

i did have knowledge of the ccj

my main issues are the phone being taken from me and the threat of locksmith coming
