Hi I would appreciate any advice.

 

Last week had a visit from the courts with a warranty. I wasn’t home and had a telephone conversation the following day.

 

I learnt that I have a CCJ which was registered in Dec 2020. As I don’t read any post from past debts I totally missed the post in regards to any of this so was the first I never about this.

 

I submitted what I needed to to all my debts around four years again and none were enforceable. So was surprised with this one being added. 
 

So please can you advise ..

 

Do I need to pay the £275 to take a gamble if I can now get this set a side.

 

Does his sound like the best thing to do.

 

Do I contact the company or does that re start the 6 years on it.

 

I can’t even prove that already 6 years has past as I got a mortgage in The years before this and pretty sure no debts were on my credit file so no idea why this happening to be honest.

 

But it is and I have to deal with it some how.

do you have a copy of the judgement?

who's the Claimant?

what is the particulars of Claim?

 

REALLY stupid idea to never open mail concerning old debts.

 

you should ALWAYS open mail, and keep your debt owners updated with your correct and current address for atleast 6yrs.

I have emailed the local court asking them for the paperwork connected to this.

 

They. sent me a letter regarding the warrant.

 

They said the court  at Northampton sent  the claim pack.

 

 I spoke with them , they couldn’t tell me much.  It was a Lloyds card debt Howard Co & solicitor brought it along the line.

Solicitors don't buy debts 

Who is their client and the ccj claimant?  Lowell's??

 

You need to ring northants bulk quoting the ccj number and ask for a copy of the judgement ccj and the particulars of claim by email pdf.

 

So you might have gotten all these but binned them? Even a court claim in a big A4 envelope from northants bulk?

 

Have you moved in recent times?

Yes I binned them unfortunately.

 

No I haven’t moved in years.

 

I will get on to asking for the above tomorrow.  Will Come back  once I have them.

 

Howard’s was who I was told to contact to make payment by the bailiff.

No that will do 

 

I think the only thing you can do is poss stick in an n245 to the court and pay it in installments. That will kill the warrant too if there is one 

 

Can't remember if you can do that on a forthwith order or not. 

 

Can't search out herding sheep 

 

P'haps @Andyorch will pop in and clarify.

 

can't see a reason for set aside n244 either.. next time read letters!!!

Even though they couldn’t produce the credit agreement , I guess because it has gone to court it it is too late to argue that also the possibility that it had dropped off credit file
 Thank you for your help I will definitely keep up with my post now,! Lesson learnt.
 

I don’t really need any credit but may need to change mortgage in a few years. If I stay with same bank would they likely credit check again , and  this effect it ?

Paperwork wriggles would have won the day had you defended the claim, but not now..ccj trumps those in most cases once judgement is handed down.

Yes you can submit an n245 to set a monthly affordable amount...on the N245 tick both boxes to suspend the warrant and vary the payment.
