      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Amex passed debt to Allied DCA help?!

Hello,

 

To give a little insight - While I was abroad in Thailand last year I was the unfortunate victim of an elaborate s cam which saw me having to max out my 2 Amex credit cards in order to pay the money the Thai people said I owed or they would not give back my Passport (police there were no help because I had signed a botched contract to rent out a boat for a few hours from these people).  Not looking for sympathy just want to make it clear I had good reason to max out these cards (although i know Amex and the DCA will not give a flying f**k).

 

this saw me max out almost £6,500 in total (they had said I owed nearly £9000) but were quick to release the debt after I paid the initial £6.5k.

 

since August, I have been paying back this amount in small installments to Amex (usually the minimum payment required each month)

- with both cards it usually comes to £300-400 (with the intention of having it all fully paid in around 24 months).

I fell behind for the last few months (with about £4k of the debt remaining from £6.5k)

 

I received an email from Amex about my missed payment last week asking for the FULL amounts to be paid on both cards or it would be transferred to a DCA - which would have been impossible for me to do.

 

Nevertheless I began budgeting for Aug to make sure I could pay the minimum required each month as I was positive they would take it rather than nothing at all as there is no way I could pay in full however, just a few days later I received an email from Allied International regarding the Amex debt.

 

I called Amex to ask about this but before I could, they simply asked for my CC details then put me on hold to then pass me to their 'collections team' who turned out to be Allied, so it seems Amex themselves will not give me the time of day anymore. When I was passed onto Allied I put the phone down after the agent got increasingly aggressive in wanting me to 'confirm my details' which I wouldn't do in order to proceed with the call.

 

I have all intentions of paying back this debt in full but I do not want to deal with any DCA's

- can people recommend my next steps as I do not know where to go from here.

 

Does Allied now own the debt?

Can I contact Amex to continue paying directly to them?

 

Any help will be much appreciated!

My first inclination would be to ignore the DCA as they have no power.

 

That leaves you with how to pay Amex.

 

Perhaps a good way forward would be to try and get a bank account for Amex and then pay by periodic instalments using your card number as a reference.

 

Ultimately they will either have to accept the payments or take Court Action (or sell the debt).

 

I wonder though if they have already trashed your credit file by reporting a default or late payments.

 

Probably a good idea to check all three credit reference agencies to see if Amex has done that.

 

Ultimately if you cannot get a bank account from them then set up a savings account and put it there and then wait for them to make the next move.  It is quite possible that somewhere down the line long after you have defaulted they will make you a discounted offer.  Your savings could go along way towards settling the sum.

dca's are totally powerless

they are not bailiffs

 

amex don't often sell their bad debts

this one is only passed to chase. allied don't buy debts.

stop using the phone too!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have never defaulted on a payment before and my credit score has always been excellent but I have no doubt this will probably tarnish it for a while. Do you know how long it takes for credit reference agencies to update on defaulted payments etc?

just pay amex directly..

please don't hit Quote...just type we know what we said earlier..

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
