Long story.  

We took a job on back in February as a company at basic living wage upon agreement that there was a 30% profit share at the end business suffered as basic living wage didn’t covered costs we went bankrupt.

 

My husband who was main contractor took on the job in own right.

Still same rate although we all worked with no pay after all we re a family and trying to help out all happy 

the owner of the job has had very little input was away more than there just transferred the wage bill

 

fast forward a little when went bankrupt they took company van happy with that.

But he bought it back so we could continue with his work and agreed to take it out any monies owed end of job.

 

Now end of job and it’s been hard weve there last 3 weeks no pay etc and his demanding wanting more than we signed up for bit we did it because were behind on everything taking basic wage even though we’re all skilled turning potential customers away etc as we stand to gain 10grand which will keep actually save us right now nothing left but wolves will be gone. All great. We got the gas signed off electrics signed off building inspector happy all At our expense. House sold moves in soon just had phone call to say we’re getting nothing as a windowsill hasn’t been put on and he’s demanding a meeting at 6.30pm and wants it doing. We have nothing on writing but have recorded the call of which was bullish we stand to loose our van which we need along with our home all for trusting some one we know and trust. Any advice appreciated because I’m about done. And literally at a loss we both have depression and anxiety. And 2 special need children I feel completely deflated and worked my butt off for the last 8 months without pay 

apologies if posted in wrong place. I don’t have the money to fight him but he does which just angers me more

thank you for letting me rant. That just feels better.

its very difficult to understand running all in one big block

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi, I'm reading this is it was an employee status, at the beginning, then moved to a contract status?

 

So more contract law than employment.

 

I am confused about all of the "he" - I think you are saying there was an original contractor who went bust, and your husband stepped in and took over the contract? Did you apply to the receiver for wages up until the point of bankruptcy?

 

I am not following ownership of the van at all.

 

What do you have in writing about the contract/ stage payments/ completion standards?

I do apologise for any confusion got myself in a rather a tizzy we as a company took on the job. 70/30 profit share taking below minimum wage  we actually saw an out. Company was taken bankrupt no

assests only company van  husband then took over the contract all great. The client at the time paid to get the van back so work could continue to carry out the contract all happy until now when property sold now we recieved phone call saying he’s not happy we’re getting nothing and he’s taking ownership of Van again I aplogise if this is written in the wrong format I m just typing we stand to

loose everything I’ve kept the wolves from the door with this guarantee again Thankyou for reading

No worries, sounds like a really stressful time.

 

Ok. So this falls under contract law, not employment law. What does the contract say about payment? If you have met the terms of the contract, you can go to court to get paid.

 

It also means you’d need to sue your own company if they didn’t pay you minimum wage - that’s a non starter. Your own company is your employer.

 

 

if the client paid for the van it seems right that he can keep the van unless you have something in writing that says otherwise.
