Filed for set aside  for two reasons and won....

1, processing delay of my defense at court meant the judge had a incomplete case file, they had my defense but did not attach before decision.

 

2...parking fine cancelled because I was in hospital for two days, medically unfit to return to car.

Yes, I received the fee back, if I recall 250/260isn but no other costs. I was expecting them to restart claim, as you said spec invoice and I had a solid defense, if they did.

that is normal, they drop the matter to avoid a costs order.

 

the reason many of them sue is not because they actually think they have have a good reason to demand the money but because they know the odds are with them on people paying up to avoid the court hearing.

 

many people think it is like on soap operas with bewigged lawyers shouting at them and a bailiff coming round to remove their furniture before they get home afterwards. The reality is most of the time the parking co has got things badly wrong but needless to say wont ever admit this or even supply you with the documents to show they have doen what they need to do.

 

PE only applies for planning permission for their cameras when they are dobbed in at a particular site as by ignoring the lawe they save a couple of hundred quid.

 

Cheaper to lie to a court and cross their fingers they dotn get clobbered tha to just do what they need to do at the outset. PE would win  a lot more claims if they paid attention to the detail, most of the other comapies are so rotten nothing would save them froma court defeat and they dont really care.

 

If you are handing out 600000 demands and 60,000 dont pay up that gives you a healthy amount of cash to harass the minority esp when 40,000 of those will cough up when tey get the court form.

 

CEL are devils for deamanding you dotn hit them for fees if they consent to a set aside.

The reality is they are on to a drubbing becuse they cant be bothered to even try to get things right but hope that you are happy with a scrubbed credit file and dont go after them
