      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just had another charge on my account for an 'arrangement fee'. When I phoned to asked what they had arranged for me, they told me it was for going over my overdraft by £13 for 3 days and that the fee is normally £25 but they had reduced it to £12.00.

 

Do they expect me to be greatful? I would not have an overdraft at all if they hadn't taken charges from me in the first place!

Thought I would Phone Debbie D'Aubney at D&G solicitors today to make sure that they had received my schedule of charges as some people on this site have suggested it can speed up the process.

When I explained what I wanted she just said in a very abrupt voice, " I'm not dealing with this" and put me through to an answering machine. What I don't understand is why my acknowledgement of service and the defence they filed, both have her name and telephone number on if she is not dealing with it. I'm not ringing her again, she's a bit scary!

Did the same thing called to see if I can speed up the process a bit and all I got was an abrupt ignorant D'Aubney who only seemed capable of being very rude and transfering calls to answer machines!! Now here is the scary bit...... I got a call back!!! Cant remember the ladies name but was told that they are waiting for a responce from the bank before they proceed. I expect you would have been told the same if you got to speak to the right person.

MCOL filed with revised sum of £744.10 - 17.12.06

Letter of Acknowledgement recieved - 22.12.06

Statements sent to DG and courts - 27.12.06 (NEARLY THERE!!)

AQ letter recieved - 17.01.07

AQ Letter handed in to court - 02.02.07

Letter from D&G offering full amount -03.02.07:D

Money in account - 14.02.07!!

 

We get charged enough in TAXES and just general living without those whom we trust with managing what little money we do get to keep unlawfully charging us, especialy when their profits are so huge.

It took me some nerve to call them as I have an anxiety problem and I stutter badly when I talk on the phone. However, I just asked whether they had received the breakdown of the charges I sent and today I got a message on my answerphone from Julie Carr to say they had. If you feel up to it you could ring her on 0121 4552701 ( this is also the number for Rachael ) and ask if they have received your breakdown.

Thanks for asking netty, but absolutely nothing. Looked at paperwork for 2nd claim and realised I made a mistake. Deadline for mcol is not up until tues 6th but they haven't defended yet! With my 1st claim AQ deadline is sunday 4th. I just hope they forget to file theirs and their defence gets struck out.

On my second claim now and the AQ deadline was 21st Feb( 9 days ago) but as yet I haven't heard a thing. Slightly worried as to what comes next. Anyone in the same boat?

are you bombarding dg with plenty of phonecalls/emails/faxes etc? they will pay you before they file theirs. just keep on to them

i'd ring the court on monday to see if dg filed an aq. if they didn't, the judge may issue an unless order (unless they file it within a specified time - their defense will be thrown out and you can file for judgment) - so ring the court on monday and ask.
