Hi,

Why do you feel this default is unfair? You did cancel the Direct Debit so VF didn't get paid. Have you checked your file recently to ensure that the default is still showing as £30 owing.

While you are considering a response to the above, the OFT debt collection guidance (before the FCA took over) stated that defaults should not be placed for small amounts. I would certainly consider that £30 IS a small amount so while you are fighting VF over this, File a notice of correction against the offending entry (up to 200 words) to explain how this event happened.

 

I would consider sending VF a SAR as before entering a default on a credit file, they should inform you and give you a chance to rectify the error before a default it filed. Your case falls smack in the middle of the farce that VF called their upgrade of the systems which caused thousands of customers massive inconvenience. As the software could not be trusted during this time, it would be incumbent on VF to check fully. They have been known to send messages to a cancelled account and the user would obviously not receive them. Why is it the first you hear of this is from a DCA. VF should have contacted you first. By sending a SAR (with plenty of identity proving documents-copies) the account history may show what (or what didn't) happen.
