      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Okay i'm new to this credit card thing i'm currently making a claim against Natwest.

But i'd like to know what charges you can claim for as i read somewhere that they are allowed to charge you £12 for going over your limit is this true?

if it is true do you just claim back on charges deducting £12 for each one for example charged £25, so £25-£12 = £13 so you would just claim £13 instead of £25,

also wot letter do you send to them asking for your 6yrs statements ?

 

any info would be greatly appreciated

Claim for the full amount they charged you if it is £38 for an overlimit fee claim the whole amount - in short anything they have charged you for ask for it back.

 

Your first letter should be the SAR letter (this is the Data Protection Act 1998 one that starts off ... 'Please supply me with a complete list of transactions and charges relating to my account history).

 

Remember to post recorded delivery and keep copies of all letters you send and all letters you receive - incase they claim to have not received your letter.

PS forgot to mention wh i have cred cards with MBNA, Marks & Speners wot i meant to ask was are there any companies being more difficult than others.

There are loads of success stories on the site honestly and all (to my knowledge) have been settled out of court.

 

I was very sceptical and, truth be told, scared about claiming against a bank (at first) - but I went in with a 'nothing ventured nothing gained attitude' and decided to stop being a victim!!!

 

Pumped full of confidence and gusto I asked for help when I needed it and boy am I glad I did. Everyone has been lovely and the advise and guidance is truly priceless - honestly - and thanks to the massive support network on here I now sport two wins under my belt.

 

Although still very much a newbie and learning more everday - I hope I can help in some small way with the things I have learnt so far. I have used my 'winnings' and ploughed them into pursuing several other claims (at the moment Tesco, RBoS and GE Capital for Debenhams & Arnotts cards) and after these I have several other claims waiting in the wings lol - well why the devil not eh :grin:.

Unfortunatly I cannot comment on MBNA and Marks & Spencers but (if you have not done so already) start a thread entitled 'Scarletrose v MBNA' and another 'Scarletrose v Marks & Spencers' or something to that effect and you will get people posting replys to your specific questions :-)

 

You can use the 'search' facility near the top of the page to look for MBNA (for example) and you will get a list of threads containing that word and i'm sure if you scout around doing that and read the FaQ's you'll be a whizz in no time at all.

I just got the Capital One letter yesterday morning so I am just waiting for the cheque now.

 

It is natural to feel nervous but if you stick to the tried and tested methods and the correct timescales you will, for sure, also be receiving a cheque in the next couple of months.

 

FYI, and you may already know this, if you are going up against your bank remember to open another bank account with someone else as they WILL close your account down :wink:

 

Hope this helps a wee bit and don't be afraid to ask questions - there is a great wealth of knowledge on this site.
