Hello,

 

Please help me on what to do as

 

I have received a CLAIM FORM from Hoist Portfolio Holding 2 LTD in Jersey,

representing Howard Cohen and Co, in regards to a remaining balance over and old Barclay's credit card.

 

Left unused since 2011.

 

The claim is asking me to repay a balance of £3272.83 the debt was assigned by MKDP LLP (ex barclaycard) and also adding £1255.99 on interest.

 

The letter is dated 17th of May 2016 and is giving me 14 days, (passed 4 days ago) to reply. or a Court Judgement will be issued.

 

Please advise me on what to do next??

defence due by 4pm Friday 17th june

 

 

what is the claim for –

Particulars of claim:

 

1.The claim is for the sum of £3272.83, in respect of monies owing under an agreement with the account No. xxxx

pursuant to the consumer creditlink3.gif act 1974 (CCA).

The debt was legally assigned by MKDP LLP (EX BARCLAYCARD), to the claimant and notice as been served.

2.The defendant has failed to make contractual payments under the terms of the agreement.

A default notice has been served upon the defendant pursuant to S.87(1) CCA.

3.The claimant claims

1. the sum of £3272.83

2. interest pursuant to S69 of the county courtlink3.gif act 1984 at rate of 8.00 % from the 27/07/11 to the date hereof 1751 is the sum of £1255.99

3. future interest according at the daily rate of £ .72

4. Costs

what is the value of the claim? value of the claim £4793.82

 

is the claim for a current account (overdraft) or credit/loan account or mobile phone account? credit card

when did you enter into the original agreement before or after 2007? i didn't enter into any agreement

 

has the claim been issued by the original creditor

or was the account assigned and it is the debt purchaser who has issued the claim. hoist

 

were you aware the account had been assigned – did you receive a notice of assignment? no i havent, i wasn't aware

did you receive a default notice from the original creditor? i did not, not personally

have you been receiving statutory notices headed “notice of default sums” – at least once a year ? i did not, not personally

why did you cease payments? i've left the country in 2011 for over two years,

and i didn't know of any outstanding balances on that credit card.

what was the date of your last payment?

sometime back to 2011, i had an account at halifax and the barclays credit card was offered to me.

 

was there a dispute with the original creditor that remains unresolved? not that i would remember

did you communicate any financial problems to the original creditor

and make any attempt to enter into a debt management plan? probably, but not that i can recall now, five years later.

get up on the MCOL website

and see if you can still AOS [ack the claim]

 

 

select defend all

leave juris unticked.

 

 

can we have the full text of the PoC box too please

I just done that, although I hope it's not too late!!! ( I still remember your words "calm down".. followed by URGENTLY)

I follow all the steps and ended on: Acknowledgement of service - Confirmation (it says "you have successfully submitted your AOS form to the court.

 

Please explain to me what is PoC so I can send you the information you've requested.

Thank you for helping me with this stressful matter. I do really appreciate it.

Please let me know if it would be advisable also to call the court tomorrow morning and find out the situation. (iI live in London), Or whether to contact the claimant.

when you've don't that

the next thing is too send two letters:

 

 

1. a CCA request

 

 

2. a CPR 31:14

 

 

READ THE FULL CLICKME LINK THREADS FIRST!

do not sign anything

leave the CCA £1PO BLANK and uncrossed

 

 

I suggest, due to the lateness of these requests

[they should have ideally been sent the day you got the claimform.]

that you send these by record delivery.

Hello

I have received a Robinson Way letter acknowledging a receipt of my request under sections 77/79 of the consumer Credit act.

 

It mentioned that account (a debt from and old Barclaycard) is with his client's solicitor Howard Cohen & Co

and they have issued a County Court Claim against me for the value of £4793.82.

 

They're currently retireving the documents I've requested

and giving me 14 days since the time I'll receive it to respond.

 

Please advise what should I do next.???
