Hi all,

 

I need a bit of advice.

I have been in a DMP for the last 6 years as the recession hit me hard. I have bene paying the DMP @ £900/month.

However, now I decided to sort out my credit score.

I have taken a secured loan on one of my properties to restructure and also for some home improvements. However, they forced me to pay all my debts. So now I sit with 10+ cheques, which I don’t really want to post until I am sure I am doing the right thing!

Most of the creditors I have negotiated down. However, there are a few I still need to get down.

However, I need to get a bit of advice. Are they cash cowing me? The Cabot (northern rock) one I got the original agreement and it look enforceable to me. However, that debt was loaded with interest up front and started @ +-£37k

Also the other 2 big ones. Amex and Apex(Halifax)

Can you please advise what will be the best cause of action? The mortgage company said they will reissue cheques if I send them letters with lower agreed. All the ones I negotiated down say they will note partially settled on my credit file. The live one and the small idem one I think I should just settle in full. Or can I negotiate with them to mark settled in full?

 

Can you please give me some advice?

Did you send a CCA to all those companies, becaus eyour paid DMP wont have done. To me, it looks like youve been well and truely cash cowed.

 

I can see at least 6 debts there that you got cash cowed on.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I didn't know any better at the time... However now I am stuck with cheques that I had to take otherwise they wouldn't complete the loan but I don't want to send at their current values.

What do you suggest is the best course of action?

Whos the DMP. I would suggest dumping it immediately if its a pay to use one.

Send a CCA request to every single one of those creditors. Then go from there. Cabot/Idem/Aktiv very very likely wont have any paperwork for your debt.

It was with Payplan. I have now cancelled them.

Cabot I CCA'd for the northern rock loan and they provided it! Also look enforceable.

What about the AIC(Amex) ones?

Also if I CCA them will then then not withdraw any settlement offers?

Settlement offers usually mean there is double that and more in PPI/penalty charges to be reclaimed.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Just because you think it might be enforceable, doesnt mean it is. Get those CCA requests off first thing in the morning. Unless of course you like wasting hundreds, if not thousands of pounds.

just to be clear on the other part of your thread title

 

 

if your debts are defaulted

then there is NOTHING you or anyone or any company

no matter what they promise..

can do to 'repair' your credit file.

 

 

these so called 'cards' and these so called 'repair companies' are simply spoofing people

 

 

...............

 

 

 

 

All references to a defaulted debt must be removed from your credit files after 6 years

has passed from date of default, whether paid off or not.

.

{the WHOLE ACCOUNT WILL VANISH, never to return}.

.

{however, this does not mean the debt itself is not still owed

consider a CCA request.}

.

This is so that someone who continues paying something

- even after 6 years from default

- should not be at a disadvantage to someone who pays nothing after default

and ends up with a clean file after 6 years.

.

Thanks for the advise!

However 2 more questions.

 

 

What should I do with the cheques they sent me while I CCA them?

 

Also the one account is still showing as active and didn't default.

Why not I dont know.

However will it be best to clear it in full?

Most of the defaults will be off next year.
