      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi

 

i have been with brighthouse since 2014 and just missed 3 payments due to money problems.

 

they are ringing me 3/4 times a day & turning up at my home.

 

i'm classed as a vunerable adult as i have a disability and i feel intimidated.

 

i have emailed head office saying i will only respond to letters and have removed their rights of access to my home

 

but still they come and threaten me with court.

 

i'm not refusing to pay 3

i have offered a lower weekly payment

 

please help i'm having anxiety attacks and i have epilepsy and live alone & feel stressed to the max

 

.i live in a block of flats with a secure entrance but they are letting themselves in via trade button.

oh dear they should not be doing that

 

and I bet you've got their silly compulsory insurances too.

 

and been charge unlawful fees too

 

go reclaim the lot

i'd be sending a strongly worded letter or email to the CEO.

 

 

have you been paying what you can

or simply stopped because they wont agree to your terms?

 

 

at the end of the day, they are a VERY LOW PRIORITY debt.

 

 

CTAX, rent, mortgage, util bills etc all come FIRST

above these people.

 

 

sadly as you've prob seen here already

they think otherwise.

just what you've put here

 

 

you are vulnerable

you do not wish and have requested them not to call at your home

you will pay what you can whewn you can

under FCA regulations they should be treating you fairly.

 

 

if the bod appears at your door

pers i'd answer it and tell them

you do not want them to call again

and you will inform the police if they do.

keep you calm

and it might be an idea to use a mobile phone to record a video

point it at him

tell him to go away and not come back.

 

 

take control

don't let them have control

 

 

and get reclaiming all those stupid compulsory insurances and penalty charges too.

so i've sent emails to the ceo and jason at brighthouse yet today they have still turned up at my home! the email was the one about not coming to my house,do brighthouse think they are above the law???

Sadly they do, it may be an option as you have an audit trail of withdrawal of right of implied access, to make a complaint to the police regarding criminal harassment of yourself by Brighthouse staff.

We could do with some help from you.

Sorry this is happening to you.

 

 

My partner had issues with this company last year.

They were calling at her house 10 times a day despite knowing she was in hospital at the time

and were trying to bully whoever was looking after the kids that day into making her payments?

 

 

They even got my mother (who does anything she is told, she has terrible anxiety issues and can't deal with any kind of conflict)

to call the hospital to ask my partner if she would call the store and make a card payment over the phone, thats how bad it got.

 

 

We did put in a letter removing their right of access, plus contacted customer relations.

Asked for a statement of everything paid so far so we could claim back late fees and such,

these never arrived and we have had no further contact from brighthouse.

 

 

The account is still defaulted which we would pay off the balance on if they would send us the details that we asked for.

 

 

As it stands, nothing is being paid.

i'm actually getting stressed to the point it's making my epilepsy worse.

how long did it take for them to stop?

 

 

did they listen when you removed their right of access?

I highly suggest taking in the letter in person, unless this will stress you more. if it will maybe someone else can take it in for you? And yes, customer relations are unfortunately for the most part, useless.

Time to get your mobile camera out and record them at your door. Then see what happens. If this continues you have the option to inform the Police, this is the last thing the Bright-Louse want. Maybe it is time to escalate to an official complaint then when Bright-Louse continue this then you can take further steps to prevent this from happening.

 

 

Every time a customer posts about them could see their tactics costing them more future customers. Time they behaved or face the consequences...

"Last week we had two choices: pay BrightHouse what was left in the bank (not enough to cover payment anyhow) or buy bits we needed for the house (milk, bread, toilet rolls, etc), so obviously BrightHouse never got paid."

 

Elsewhere, an anonymous adviser on the site expresses despondency at BrightHouse's enduring popularity. "It's not CAG's way to be judgmental, but I become quite frustrated when I see that people have pretty much furnished their homes and bought computers, phones and TVs as well from this company. If they could only do without for a few months, they could probably get a far better deal from a decent store and save themselves a whole bushel of grief."
