well i finally did something about the yorkshire bank ripping me off for the last 5 years and handed a dpa letter in at my branch addressed to the manager with a cheque for the £10 .thanx to this forum i am doing something ...thanx a lot and ill keep ya posted

 

just as an addition to the thread can anyone tell me as the account is a joint account do we both ave to send seperate dpcs in or will one do off both of us ...cos we sent one in as a couple and i hope that is right

well i got my reply off fiona hutton this morning telling me that they will provide me with copies of my statements ...also reminding me that they ave 40 days and they will send them asap...and also that they ave received my £10 so i must be getting my statements at the right price instead of the £5 each that they told my wife we would ave to pay ....so i am just waiting on statements arriving now and then we can go to the next stage ...

reminding me that they ave 40 days and they will send them asap...

 

Zultar - phone your branch on Tuesday. Your statements will go to your branch & they will send them on to Fiona for her to send to you. If you speak to whomever will deal with them at the branch they'll let you collect them & cut out the middle man. Just say to the branch that statements have been ordered & for security reasons can you collect them rather than having them sent through the post via Fiona. Don't trust them to ring you when they arrive in branch, call them every morning around 10 o'clock (after their internal mail has arrived). This way you'll get them within 10 days rather than have them sat on a desk in Glasgow until the 40 days is almost up.

 

You'll need to collect 2 batches as pre & post July 2005 arrive seperately & usually a day apart but don't leave it until both batches are there to collect or they'll probably get sent up to Glasgow, collect them the same day.

well i got my statements this morning and they have charged me £1013 since i opened the account ...i will post the preliminary letter off in the morning and see what happens ...just a quick question should i send the preliminary letter to my branch or to clydesdale head office in glasgow ...thanx a lot

 

also would it be worth e mailing cb head office and if so does anybody ave the address ...thanx a lot

 

and by the way that was a good bit of advice you gave me trunny .....cheers

To your branch Zultar (as per their grievance procedure) but make sure you send it special delivery. Doesn't matter about the 1 day detour to head office as your time frame is clearly stated in the letter.

 

Glad you got the statements quick, just shows that if head office wanted to help, everyone would have them as fast.... they must hang onto them for the 40 days just to prove a point.

well i sent the preliminary letter yesterday registered post and they ave it today the 12th may according to the tracker at royal mail ...so lets wait till 26th may and then the lba is goin if not sorted by then ....i wont hold my breath

received letter off my branch today stating that the charges were done so in accordance with their tariff and that no refund will be made ...do i wait for the 14 days to be up then send the LBA or should i just send it straight away cos its quite obvious that they aint gonna pay up .....and dont accept that the charges are illegal

Afraid I don't know the answer to your question zultar. I;d be inclined to press on as you've had their response to your initial request but I think there's been some discussion about this elsewhere (will have a poke around & see if I can find it). Sure someone will be along soon who knows the answer.

 

You're doing well though, I haven't heard a thing, not even an acnowledgement they've recieved my letter (my ex manager's an ignorant b*tch, seems to forget we're still mortgage, insurance & savings customers).

Wait the 14 days please, just because then it will look as thought you have been more than resonable if you had to go to court!

Just then you have tried to appease the situation,and the court will like that, it makes the bank look less competant if they havent sorted this out by then.

well 14 days are up and no attempt to try and settle this ...so ive sent the LBA letter registered post and will wait and see if they take any notice of this ...again i wont hold my breath

well i got a reply today from neil mckirdy at cb

it says

 

i refer to your letter received in your branch on 26th may and would advise that

your complaint file has been reopened (didnt know it had been closed ) and is currently under review

i hope to respond to your complaint shortly and in any event within 28 days

 

please be assured that every effort is being made to bring your complaint to a satisfactory conclusion

 

this letter as been received by me right on the 14 days that i gave in the lba

should i go ahead and take action straight away or give neil mckirdy the time to reply and see what happens ??

This is your claim and you set the deadlines .Do not let the bank dictate the pace.Always stick to what you have said .You have said you will start a claim in 14 days , so you start your claim.The bank is just stalling you.

well due to circumstances beyond my control i wasnt able to file the moneyclaim but i was wondering if any one can help me due to it being 2 months since i last heard off the bank about this claim can i still file the moneyclaim now or do i have to send the letter before action again...please help i dont know if to just file claim or not ...thanx a lot
