I am enquiring on behalf of my husband,

 

 

he had a credit card with MBNA,

they were sending letters offering me loans in sept 06.

 

 

He rang them and requested £3000 loan

was informed that they could not give him the loan as he had £6100 outstanding on his credit card with them,

they offered him £7500 loan providing that £6100 was cleared of the card

and balance put into his bank account and that my credit card limit reduced to £1000 .

 

 

He agreed to this and took out the loan.

 

 

his card limit was never reduced and he spent the limit on it.

 

 

He has since been in default on the credit card for 5 years ,

would he have any recourse .?

 

 

if so would you help us with the procedures as its all new to us.

Send a cca request under s 77 for loan, s78 for cc to arrows

 

send SAR to MBNA for all the info

 

in order to see whether there are any grounds for any complaint

 

Unlikely on what you have described but maybe other avenues
