      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In response to post 95 you mention a friend had your Swift info but now at UNI.

 

I can't see history notes here so you can ring Swift and tell them not sent with SAR.

Or better still put it in writing and tell them you'll report them to the ico if they fail to fully comply with the sar.

The only way they will send the history notes is if the court order them too and they will heavily redact them "privileged information".

 

ICO will do nothing.....been there done that there..... the ICO are USLESS.

Any of these companies only send what they want and hope that the you don't know what you should have.

Just because you might not get or you might have to fight is not the reason not to try.

 

Just remember to keep all of the evidence of your efforts so it can never be questioned that you didn't try and they didn't comply.

They record phone calls so you are entitled to the recordings, history notes, copies of correspondence and I would request all of this and a copy of actuarial accounts.

 

They are doing something wrong but purposely make everything complex so you cant work out what but one day they will give somebody the evidence needed.

Only when there is hard evidence is it worth considering joint action or anything else, going to court with an assumption is no good.

so its a waste of time trying to get the history notes.

as anyone ever received them, and was there anything in there that they could fight with.

 

Yes borrowers have received the history notes by asking for them. LL is right to say there will be info blotted out, by felt tip it looks like. Wonder what it would reveal? I would like to hear a Judge can order this secret info is shown as why is it hidden? I wouldn't say a waste of time. it's all evidence of the non transparency of Swift.

I have been away for a while doing some studying and trying to find a way to deal with swift.

I received the history notes from swift today but I don't know what I am looking for in the notes,

as anyone got any idea.

so on to my next move.

I need to do a claim against their complaint my next court date is the 26th of October that's to do with the valuation of my house and them seekin to sell.

 

What happened on 26th Oct?

 

 

The CAB can help with dealing with the Insolvency Practitioner and now you have the Swift docs, your complaints against Swift can be dealt with at the same time. Bottom line, you need legal support before you blow a gasket and the CAB can slow down this runaway process you have been caught up in. You need the support to think and breath. Nothing to lose to make an appointment.

 

As Meelis says, looks like there wouldn't be any assets for the creditors if the Mortgage and Swift were paid with the figures they demand now. The situation needs to be reigned in.

that was the bankruptcy hearing, I went in and handed a notice to the judge judge stating that there as been no proof of claim upto this date, and I have been requesting proof from before bankruptcy judgment was made. they did a drive by valuation.

case has been adjourned until January.

You really need to talk this all through and you know my suggestion. It's going round in circles. Swift are putting a spanner in the works and need taking to task. Their customers are ignored so you need a legal authority to compile your complaint to make them sit up and listen. Make a list of your reasons, i.e not stated in t&c's the int rate will never decrease, as you were advised otherwise. The high and hefty charges. The small print t&c's not clear and transparent. The loan takes it beyond retirement. Affordability? I've started and i'm sure you can carry on with the list.

 

Can you tell us in more detail how you managed to get a PPI refund, how much was refunded and how was it refunded, to loan or to you. Great thanks.

it took me 3 years to get it back.

a specialist company was helping me. and a little help from the financial umbudsman

the cheque was sent to me. I received £7.000 I think, I am still looking for the documents

I had to pay a fee to to the cmc of £1,800

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Can you explain the little help from the FOS as we continue to hear Swift deny responsibility as it was sold by a broker.

 

The regulator now being the FCA, has problems with them as Swift say they are unregulated and are not obligated to comply.

 

Hope this all starts to go in the right direction for you very soon.

That explains it thanks, glad for you the broker was still in business.

 

If the broker is still trading, maybe the complaint for selling of the loan can be copied into them also.

what I was showing on this letter is,

they said I signed an agreement about paying back loan at end of term.

if you look at the paragraphs on page 3 and 6 where I put a cross, I did not sign I don't even remember telling the this information.
